TRAI recommends new approach to set radio ads, programme code; suggest that the MIB prescribe a Programme Code and Advertisement Code for all radio services

The Telecom Regulatory Authority of India (TRAI) released its recommendations regarding the framework for service authorizations for broadcasting services under the Telecommunications Act, 2023. This new framework aims to replace the previous licensing system under the Indian Telegraph Act, 1885, aligning the authorization process for various broadcasting services such as television channels, DTH services, and community radio. The recommendations were developed following a comprehensive consultation process that included stakeholder comments and an Open House Discussion.

The newly recommended authorizations outline two distinct sets of terms and conditions: one for applicants seeking to obtain broadcasting service authorizations and another for authorized entities during the provision of services. Key features include a voluntary migration process to the new authorization framework for existing licensees, the addition of new service categories like ground-based television broadcasting, and provisions for technology-neutral radio broadcasting services. The framework also facilitates infrastructure sharing and encourages interoperability in set-top boxes and television sets.

Further recommendations emphasize the need for harmonization of terms and conditions across services and propose the removal of minimum net worth requirements for IPTV service providers. With an emphasis on enhancing ease of doing business in the sector, the recommendations aim to ensure a more efficient regulatory environment for broadcasting services, promoting growth and innovation.
