Mr. Tejpal was accused of raping his colleague in an elevator of a five-star hotel. He was arrested on November 30, 2013, by the Goa Crime Branch and was granted bail on July 1, 2014, by the Supreme Court.

In February 2014, the Goa Crime Branch filed a 2,846-page chargesheet against Mr. Tejpal.

Tejpal describing it as “a long-fought for vindication” in a statement read out by his daughter Cara outside the court in Goa.

“In November 2013 I was falsely accused of sexual assault by a colleague. Today the Hon’ble Trial Court of  Additional Sessions Judge Kshama Joshi, in Goa, has honourably acquitted me. In an awfully vitiated age, where ordinary courage has become rare, I thank her for standing by the truth,” Tejpal said.

A sessions court in Goa had adjourned the hearing on Wednesday and posted it for May 21 due to lack of staff in wake of the coronavirus pandemic. On Wednesday, Tejpal was present in the court along with some of his family members and lawyers.

Special judge Kshyama Joshi pronounced the judgment, and the reasons for acquittal will be known in due course of time.

On September 29, 2017, the court framed charges against him under various Sections of the Indian Penal Code.

The trial commenced in March 2018 but got interrupted due to several factors, one of them being Mr. Tejpal seeking a discharge in the case, for which he first moved the sessions court, then the High Court and later the Supreme Court.

In August 2019, the top court declined his plea and ordered that the trial be held in-camera (not open to the public) and be completed in six months.

The trial finally began on December 7, 2020, and the survivor was examined and cross-examined for an entire month till January 7, 2021, by physical appearance and through video-conferencing.

The prosecution examined 71 witnesses and the defense had four witnesses, including family members of both the accused and the survivor. The trial concluded at the end of February 2021 and, after final arguments were made by both sides, the judgment was reserved.

जिस अंदाज में यूपी पुलिस ने मंगलवार देर रात हाथरस की बलात्कार पीडिता का बिना परिवार वालों को साथ लिये ही अंतिम संस्कार कर दिया उससे इतना तो साफ हो गया है कि हाथरस के इस घृणित कार्य में केवल अपराधी ही नहीं अब सरकार और पुलिस भी शामिल हो गयी है. पुलिस तो अब ये तक कहने लगी है कि उस लड़की के साथ रेप हुआ या नहीं ये अभी जांच का विषय है . उत्तरप्रदेश पर सच में गंभीर सवाल खडे हो रहे है और उतने ही सवाल ये भी कि अगर ये किसी गैर बीजेपी राज्य में हुआ होता  तो क्या मीडिया उतना ही चुप रहता .

सवाल तो ये भी उठ रहा है कि अगर सरकार कानून व्यवस्था नहीं संभाल पा रही तो राज्यपाल आनंदी बेन पटेल क्यों चुप है . वो तो खुद एक महिला है कम से कम रिपोर्ट तो मांग लेती . महाराष्ट्र के राज्यपाल भगत सिंह कोशियारी से सीखिये वो तो कंगना रानाऊत से लेकर पायल घोष तक से मिल लेते है.बीएमसी अफसरों को हडका देते हैं. असल में मीडिया से लेकर सरकार तक सब इसलिए चुप है क्योंकि ये भाजपा शासित योगी सरकार है .

अलीगढ के आईजी पीयूष मोर्डिया ने तो कह दिया कि अभी बलात्कार की पुष्टि तक नहीं हुयी है लेकिन उनके पास इस बात का जवाब तक नहीं है कि पुलिस ने किस हैसियत से सफदरजंग अस्पताल से उस लड़की का शव लिया और बिना परिवार वालों के ही उसका अंतिम संस्कार कर दिया .

पुलिस का कहना है कि हाथरस गैंगरेप पीड़िता ने उपचार के दौरान विवेचक के सामने कई बार अपने बयान बदले थे। इसका विवेचक की रिपोर्ट में उल्लेख किया गया है। पीड़िता के अलग-अलग तिथियों में लिए गए बयान में अलग-अलग बातें सामने आई हैं। इतना ही नहीं, मेडिकल रिपोर्ट में रेप की पुष्टि नहीं हो पाई है।

उपचार के दौरान युवती के तीन बार बयान हुए। पुलिस अधिकारियों के मुताबिक, पहली बार में युवती ने रेप से जुड़ा कोई बयान नहीं दिया था। उसके बाद 19 सितंबर को बयान हुए, जिसमें कहा कि मेरे साथ छेड़छाड़ हुई है। बयान के आधार पर पुलिस ने धारा बदलकर आगे की कार्रवाई शुरू कर दी थी। उसके बाद 22 सितंबर को बयान दर्ज हुए। जिसमें पीड़िता ने कहा था कि उसके साथ रेप हुआ है। नए बयान के आधार पर पुलिस ने आगे की कार्रवाई शुरू कर आरोपियों को गिरफ्तार किया था। मेडिकल रिपोर्ट पर गौर करें तो उसमें युवती के साथ रेप की पुष्टि नहीं हुई है।

घटना के अनुसार, 14 सितंबर की सुबह गांव चंदपा की युवती अपनी मां के साथ खेत पर गई थी। वह खेत में घास काट रही थी। इसी बीच संदीप नाम का एक युवक वहां आ धमका और छेड़छाड़ करने लगा। युवती ने विरोध किया तो हमला बोल दिया। युवती के चिल्लाने पर युवती की मां आरोपी की तरफ दौड़ पड़ी। इतने में आरोपी मौका पाकर फरार हो गया था। घायल युवती को आनन-फानन में अस्पताल ले जाया गया।

युवती के भाई ने करीब 10:30 बजे थाने पहुंचकर बताया कि उसकी बहन का गला दबाकर मारने का प्रयास किया गया। मामले में एफआईआर दर्ज हुई। युवती की गंभीर हालत को देखते हुए उसको एएमयू के जेएन मेडिकल कॉलेज में भर्ती कराया गया। यहां चिकित्सकों ने देखा कि युवती की कमर की एक हड्डी टूटी है। इतना ही नहीं, दोनों पैर भी सही से काम नहीं कर रहे थे।

“My husband is a convict in the Nirbhaya case but he is innocent…Now, I want to be legally divorced from him before he is hanged as I don’t want to live the life of a widow,” Punita Devi, wife of Akshay Thakur, said in her petition filed at a family court in the local district court of Aurangabad. Son of Saryug Singh and Malti Devi, Akshay Thakur hails from the Lahangkarma village of Bihar’s Aurangabad district. The court has fixed March 19 as the next date of hearing.

My client [Punita Devi] has a right to seek divorce from her husband under section 13(2)(II) of the Hindu Marriage Act, which says a woman can seek divorce from her husband if he has been found guilty of rape, sodomy or bestiality. I have filed her petition in the family court of the district,” Mukesh Kumar Singh, Punita Devi’s lawyer told local journalists in Aurangabad. Ms. Devi also has a son to look after.

All the four convicts of Nirbhaya — Mukesh Singh (32), Pawan Gupta (25), Vinay Sharma (26) and Akshay Kumar Singh (31) are currently lodged in Tihar jail and are set to be hanged on March 20. They have been using tactics to delay the hanging, which has already been postponed twice. They have even approached international court and India’s Human Rights Commission.

However, some legal experts feel that there is no chance of any further delay as all formalities have been completed and the convicts have exhausted all legal remedies.

The much-awaited execution day for the Nirbhaya gangrape convicts has been decided by a Delhi Court today. The four convicts – Pawan, Akshay, Vinay and Mukesh will be hanged on January 22, 2020, at 7 o’clock in the morning.

The verdict was made live on video conference to connect the court with the convicts who are lodged in Tihar Jail.

Additional Sessions Judge Satish Kumar Arora of the Patiala House Court had reserved the order earlier in the day on the plea by Nirbhaya’s parents seeking issuance of the death warrants of the four convicts. Before pronouncing the date, the judge spent some time speaking to each of the convicts via video conferencing after asking media persons to step out.

The parents of Nirbhaya had urged the court to expedite the execution proceedings as delay only added to their prolonged agony since the fateful night of December 16, 2012.

On Monday, the court dismissed an application filed by the father of one of the death-row convicts in the Nirbhaya rape case, who had questioned the credibility of the sole witness by claiming that he was “tutored” and sought the registration of FIR against him.

Out of the six accused in the gangrape and murder charges, the main accused Ram Singh had allegedly committed suicide in Tihar Jail during the pendency of the trial while another accused was a minor at the time of the commission of the crime and was hence sent to a reform facility for juveniles and released after serving three years.

District Judge Dharmesh Sharma also imposed an exemplary fine of Rs 25 lakh in the case and has to be paid within a month.

“This court does not find any mitigating circumstance. Sengar was public servant and betrayed people’s faith,” the judge said while declining the plea for lenient approach in sentencing him.

The court also said the conduct of Sengar was to intimidate the rape survivor. It also directed that the rape survivor be paid an additional Rs 10 lakh as compensation to the mother of the victim.

The court had on Monday convicted Sengar for rape under the Indian Penal Code and the POCSO Act for offence by a public servant committing penetrative sexual assault against a child after holding the victim to be a minor.

Terming the Unnao case “an extraordinary one”, where the court has to “consider her continued suffering”, the CBI had sought life imprisonment, the maximum punishment for charges Sengar was convicted under.
The Unnao woman was kidnapped and raped by Sengar in 2017 when she was a minor. The rape complaint, however, was registered only after she attempted to immolate herself outside Chief Minister Yogi Adityanath’s official residence in Lucknow.

She took the extreme step after her father was allegedly thrashed by Sengar’s brother, Atul Sengar, taken to jail instead of hospital even though he was grievously injured and died two days later in police custody. The matter came to light after a video clip showing Atul Sengar beating the father went viral on the social media.
Amidst public outrage, the case was transferred to the Central Bureau of Investigation (CBI) and both the Sengars and two others were arrested.

On July 28 this year, the rape victim was severely injured after the car in which she was travelling was hit by a truck. Two of her aunts were killed in the accident and she and her lawyer were critically injured. The family alleged foul play in the accident.

District Judge Dharmesh Sharma convicted Sengar of rape under the Indian Penal Code and POCSO Act for the offence of a public servant committing penetrative sexual assault against a child .

Sharma, however, acquitted co-accused Shashi Singh of all charges. Sharma pronouncing the verdict, rapped the CBI for the “inordinate delay in the case”,

.  The court will hear arguments on quantum of sentence on Tuesday.

The survivor was kidnapped and raped by Sengar in 2017 when she was a minor, the court ruled.  The trial in the high profile case was held in-camera after the Supreme Court transferred the matter from Unnao to the National Capital.

The court also rejected the defence objections that the crime was reported much later and that it was orchestrated by the survivor’s uncle. The court observed that the survivor did not “utter any word” in view of the threat to her life and her family.

The court had on 9 August framed charges against Sengar and Singh under sections 120 b (criminal conspiracy), 363 (kidnapping), 366 (kidnapping or inducing a woman to compel for marriage), 376 (rape) and other relevant sections of the Protection of Children from Sexual Offences (POCSO) Act.

The judge heard the case on a day-to-day basis from 5 August after it was transferred to Delhi from a court in Lucknow on Supreme Court’s directions.

A special court was also held at AIIMS hospital in Delhi to record the statement of the rape survivor, who was admitted there after she was air-lifted from a hospital in Lucknow.

The woman and her family is provided CRPF security as per the apex court’s orders. They have now been shifted to a rented accommodation in the national capital with the assistance of the Delhi Commission for Women .

Cyberabad Police Commissioner VC Sajjanar said that accused Mohammad Arif,  Naveen,  Siva and Chennakeshavulu were killed in a police encounter in Chatanapalli, Shadnagar between 3 am and 6 am today.

Nirbhaya’s mother Asha Devi said that just as the police did justice in the Telangana case, similarly Nirbhaya’s culprits should also be punished. She said that the culprits of his daughter Nirbhaya have been sentenced to death by the Supreme Court but they have not yet been hanged. We have not got justice yet .

Reports says that women survived a brutal rape some time ago was on Thursday set ablaze in Uttar Pradesh’s Unnao by a group of men. The five men who had raped her in March this year, are suspected to be behind the latest attempt to kill her.

The rape accused and his friends took the woman outside her village and into the fields and doused her in petrol before setting her on fire. She was raped by the five men in March while police could manage to arrest only three of them and two others were still on the run.

UP Police arrived at the information of the father and brought the victim to the district hospital. Seeing the condition of the victim here, Lucknow has been referred. Meanwhile, the police have arrested the five accused. Two of the arrested accused are also accused in the gang rape case along with the woman and she was recently granted bail. The gang-rape accused, together with their friends, carried out the incident.

SP Vikrant Veer told that a case was registered in Lalganj police station area of Rae Bareli in March. It was alleged on behalf of the girl that two people were gangraped on the pretext of marriage. The names of these two accused are also involved in the incident of burning petrol. The victim’s family says that the accused, who were released from jail, had been threatening them for the last two days.

The victim has said that she was going to Baiswara Bihar railway station to catch a train to go to Rae Bareli. At Gaura Mor, village Harishankar Trivedi, Kishore, Shubham, Shivam and Umesh surrounded him and stabbed him with a stick on his head and a knife on his neck. Meanwhile, when she fell due to dizziness, the accused put petrol and set it on fire.

The victim’s parents have sought court’s direction to Tihar Jail authorities to speed up the execution of the rape convicts.

The court will hear the matter on November 25.

They moved the application since the earlier two judges hearing the matter got transferred and the matter is getting adjourned continuously, the plea said.

The special fast track court, set up to hear cases of sexual harassment cases exclusively, of Patiala House Court is now vacant and no judge has been appointed till now.

The application said that victim’s parents approached the court since the convicts have exhausted all legal remedies.

In December last year, the parents of Nirbhaya, the 23-old paramedic who was gang-raped in December 2012, approached the court to fast-track the procedure to hang all four convicts in the case.

Supreme Court on December 12, 2018, dismissed the PIL seeking a direction to the Centre to execute the death penalty awarded to four convicts — Mukesh, Pawan, Vinay and Akshay — in the sensational Nirbhaya gangrape and murder case.

A day after Chief Justice of India Ranjan Gogoi took cognisance of the letter sent by the Unnao rape survivor, the Supreme Court of India has transferred all cases related to the Unnao incident out of Uttar Pradesh. Additionally, the court also demanded presence of a “responsible officer of the Central Bureau of Investigation (CBI)” in the court.

The CBI officer is required to appear before the Court at 12 pm today (Thursday). The officer will have to inform the apex court of the details of the rape case as well as the accident case of 29 July, which is also being investigated by the CBI. In case the investigation details are such that they cannot be divulged in open court, then the CBI officer will be heard in chambers, Gogoi clarified.

Solicitor General informed the Supreme Court bench led by the CJI that the CBI investigating officers are out of town for the probe into the Unnao case. He asked for an extension till Thursday evening, but Gogoi refused to adjourned the hearing. Gogoi said gather instructions over the phone. “CBI director can do so.”

the Supreme Court has clearly said that all cases related to the Unnav rape case  including the rape allegations, the survivor’s father’s imprisonment and death, the very recent truck accident which claimed the lives of two aunts of the girl (and any other related cases filed in the state),  be transferred to Delhi.
