Ministry issues advisory to private channels

Union Ministry of Information and Broadcasting has today advised private TV news channels against making false claims and using scandalous headlines. In a detailed advisory issued today, the Ministry has called for adherence to the provisions of Section 20 of The Cable Television Networks (Regulation) Act, 1995 including to the Programme Code laid down under it.

The Ministry has found that in the recent past several Satellite TV channels have carried out coverage of events and incidents in a manner which appears to be unauthentic, misleading, sensational and using socially unacceptable language and remarks, offending good taste and decency, and obscene and defamatory and having communal overtones. The advisory has cited the Ukraine-Russian conflict and the incidence in North-West Delhi in particular where TV news content and debates have been found in violation of Programme Code.

While in the case of reporting on Ukraine-Russia conflict the Ministry has found channels making scandalous headlines unrelated to the news item and journalists making unsubstantiated and fabricated claims and using hyperbole in order to incite audience, in case of Delhi violence, certain channels have aired news items with provocative headlines and videos of violence that may incite communal hatred among the communities and disrupt peace and law and order. The channels have further fabricated headlines giving communal colour to actions of authorities.

The Ministry has noted and also cautioned private TV channels against broadcasting debates having unparliamentary, provocative and socially unacceptable language, communal remarks and derogatory references which may have a negative psychological impact on viewers and may also incite communal disharmony and disturb the peace at large.

Citing these instances of violation, the Ministry has today expressed serious concern over the programmes aired and strongly advised against violation of provisions of The Cable Television Networks (Regulation) Act, 1995 and the rules under it.

SC ask for regulatory mechanism for TV

The Supreme Court asked for a “regulatory mechanism” for tv channels and said government is silent on the action taken against TV channels in a case linked to media reporting on the Tablighi Jamaat .

“The government is silent on the action that has been taken and the power it has to regulate the TV channels. If there is no regulatory mechanism, create one or else we will hand it over to outside agency. Regulation cannot be left to the NBSA (News Broadcasters Standards Authority)” Chief Justice SA Bobde said . He pointed that the top court is not satisfied with the centre’s affidavit which was shared in the top court . the top court berated the government for having a junior officer file what it called an “extremely offensive and brazen” response.

“First, you did not file a proper affidavit and then you filed an affidavit which did not deal with the two important questions. This way it cannot be done Mr Mehta… we are not satisfied with your reply. We asked you to tell about what action taken has been taken. But not a whisper in your affidavit,” the bench headed by Chief Justice SA Bobde told Solicitor General Tushar Mehta, underlining that the government did not deal with the Cable TV Network Act in its response as it highlighted that “applicability of the Act in controlling media has a great consequence in this country”.

“Tell us what’s the present legal regime you have… you haven’t told anything,” the top court said. The Solicitor General told the court that a fresh affidavit will be filed.

The centre has defended the media in this case and said in its response to the Supreme Court that there was “no instance of bad reporting”.

The Supreme Court last month pulled up the centre on its affidavit and said it “must tell us instances of bad reporting” and what action had been taken. “Freedom of speech is one of the most abused freedoms in recent times,” Chief Justice SA Bobde had said during the hearing last month

Stars moved plea against tv channels

As many as 34 top Bollywood producers and four film industry associations Monday filed a lawsuit in the Delhi High Court, seeking to restrain television channels from making “irresponsible, derogatory and defamatory remarks” against the Hindi film industry.

The suit has been filed against Republic TV’s Editor-in-Chief Arnab Goswami and journalist Pradeep Bhandari of the channel, and Times Now’s Editor-in-Chief Rahul Shivshankar and its prominent anchor Navika Kumar as respondents.

The production companies include those run by Salman Khan, Aamir Khan, Shah Rukh Khan, Karan Johar, Farhan Akhtar and Ajay Devgn.

They have been assailed for conducting media trials of Bollywood personalities and interfering with the right to privacy of persons associated with the film industry, in the wake of Sushant Singh Rajput’s death and the subsequent arrest of his girlfriend Rhea Chakraborty.

“The livelihood of persons associated with Bollywood is being severely impacted by the smear campaign being run by the defendants. This is in addition to the ongoing pandemic which has resulted in extreme revenues and work opportunity loss,” reads the suit filed by the law firm DSK Legal.

“The privacy of the members of Bollywood is being invaded, and their reputations are being irreparably damaged by painting the entire Bollywood as criminals, seeped in drug culture, and making being part of Bollywood as synonymous with criminal acts in the public imagination.”
