										<content:encoded><![CDATA[<p>The Union Cabinet chaired by the Prime Minister Shri Narendra Modi today has given its approval for extending the contribution both 12% employees&#8217; share and 12% employers&#8217; share under Employees Provident Fund, totaling 24% for another 3 months from June to August, 2020, as part of the package announced by the Government under Pradhan Mantri Garib Kalyan Yojana (PMGKY)/ Aatmanirbhar Bharat in the light of COVID-19, a Pandemic.</p>
<p>This approval is in addition to the existing scheme for the wage months of March to May, 2020 approved on 15.04.2020.  The total estimated expenditure is of Rs.4,860 crore.  Over 72 lakh employees in 3.67 lakh establishments will be benefitted.<br />
<strong>Salient Features:</strong><br />
<strong>The salient features of the proposal are as under:</strong></p>
<p>For the wage months of June, July and August, 2020, the scheme will cover all the establishments having upto 100 employees and 90% of such employees earning less than Rs. 15,000 monthly wage.</p>
<p>About 72.22 lakh workers working in 3.67 lakh establishments will be benefited and would likely to continue on their payrolls despite disruptions.</p>
<p>Government will provide Budgetary Support of Rs.4800 crore for the year 2020-21 for this purpose.</p>
<p>The beneficiaries entitled for 12% employers&#8217; contribution for the months of June to August, 2020 under Pradhan Mantri Rozgar Protsahan Yojana (PMRPY) will be excluded to prevent overlapping benefit.</p>
<p>Due to prolonged lockdown, it was felt that businesses continue to face financial crisis as they get back to work. Therefore, the Hon&#8217;ble FM, as part of Aatmanirbhar Bharat, announced on 13.5.2020 that the EPF support for business and workers will be extended by another 3 months viz. for the wage months of June, July, and August, 2020.</p>
<p>The steps taken by the Government from time to time to ameliorate the hardships faced by the low paid workers are well accepted by the stakeholders.</p>

										<content:encoded><![CDATA[<p>The Supreme Court asked the Centre to issue directions to states for payment of salaries and providing necessary quarantine facilities to doctors and healthcare workers engaged in treating COVID-19 patients.</p>
<p>The government told the court it would issue the necessary directions.</p>
<p>A bench of justices Ashok Bhushan, S K Kaul and M R Shah said that doctors and healthcare workers treating COVID-19 patients should not be denied quarantine facilities.</p>
<p>The top court asked the Centre to file a compliance report within four weeks on payment of salaries and quarantine facilities to doctors and healthcare workers and warned that non-compliance would be viewed seriously.</p>
<p>The bench was hearing a plea filed by a private doctor raising questions on the Centre&#8217;s May 15 decision that 14-day quarantine was not mandatory for doctors.</p>
<p>Doctor Arushi Jain, in her petition filed through advocates Mithu Jain and Arjun Syal, had alleged that front line healthcare workers engaged in the fight against COVID-19 are not being paid salaries or their wages are being cut or delayed.</p>
<p>During the hearing, Solicitor General Tushar Mehta, appearing for the Centre said that government would issue the directions to states and union territories within 24 hours to ensure timely payment of salaries to doctors and health care workers.</p>
<p>He said that the May 15 circular on Standard Operating Procedure (SOP) will also be modified and do away the clause for non-mandatory quarantine for healthcare workers engaged in COVID duty.</p>
<p>Mehta also gave the assurance that a new order would be issued for providing suitable alternate accommodation for doctors and healthcare workers engaged in COVID duty to avoid risk to their family members.</p>
<p>He said that Centre is also thinking to make non-payment of salaries by hospitals to health care workers a criminal offence under the National Disaster Management Act.</p>

										<content:encoded><![CDATA[<p>The Supreme Court on Friday asked states to facilitate settlement between private companies and their employees over wage payment. It also asked for a report to be submitted before labour commissioners.<br />
The court said that no coercive action should be taken against private firms which have failed to pay full wages during the lockdown period.</p>
<p>“We directed no coercive action to be taken against employers. Our earlier orders will continue,” the bench said.</p>
<p>It also asked the Centre to file affidavit within four weeks on legality of March 29 circular that mandated payment of full wages during lockdown.</p>
<p>The court was hearing a bunch of petitions filed by several companies, challenging the Ministry of Home Affairs order to pay full salaries to employees during the 54 days of lockdown.</p>
<p>“Industries and labourers need each other and efforts should be made to resolve dispute over wage payments,” the bench said.</p>
<p>The court had on June 4 observed that some negotiations have to happen between employers and workers to iron out what has to be done for the salary for these 54 days.</p>
<p>Reading the order Justice Bhushan said: &#8220;No industry can survive without the workers. Thus employers and employee need to negotiate and settle among themselves. If they are not able to settle it among themselves, they need to approach the concerned labour authorities to sort the issues out.&#8221;</p>
<p>&#8220;We directed no coercive action to be taken against employers. Our earlier orders will continue. A detailed affidavit has to be filed by Centre in last week of July. Negotiation between employees and employers to be facilitated by state government labour departments&#8217;,&#8221; it directed.</p>
<p>The SC also directed employers to set a date for settlement which may be effected by the MHA; asked for the settlement to be published for benefit of all employees; has asked state governments and labour commissioners to facilitate the exercise; and stated that workers willing to continue work should be allowed to do so regardless of progress on the settlement.</p>
