The petition, filed by general secretary SC Mishra, refutes the merger and claims the MLAs incur disqualification for voluntarily giving up their membership.

It comes a day after the party’s central leadership had on Sunday caused a new twist in the Rajasthan deadlock and issued a whip to the six MLAs to vote against the Gehlot government in any proceedings of the house, including in case of a no confidence motion.

Gehlot has been struggling to keep his government afloat after a rebellion by Sachin Pilot and MLAs loyal to him, and Mayawati’s new ploy could be just enough to tip the scales against the Congress in the state.

According to sources, Gehlot has been claiming the support of 103 MLAs in the 200-member assembly, but if the six MLAs are forced to vote against him, it could bring his government into a minority.

All the six BSP MLAs had last year merged with the Congress, which could lead to a tangle of technicalities as there are no BSP MLAs in the Rajasthan assembly.

Meanwhile Governor Kalraj Mishra today returned with queries the proposal of Chief Minister Ashok Gehlot for the assembly session from Friday. This was a revised proposal sent to the Governor but it also did not cut ice with him. The Congress has accused the governor of acting under pressure from the BJP to stall a test of strength in the assembly. The Supreme Court is all set to hear at 11am today a petition filed by Rajasthan Speaker CP Joshi against the rebel MLAs led by now-sacked deputy chief minister Sachin Pilot who engineered a revolt against the Gehlot government. The court on Thursday had refused to restrain the Rajasthan High Court from passing an order on the plea of the rebel MLAs challenging the disqualification notice against them and said it would be subject to the outcome of petition before the apex court.

Observing that the “voice of dissent” in a democracy cannot be shut down, the Supreme Court had refused to accept the plea of Rajasthan Assembly Speaker CP Joshi to either stay the matter pending before the high court or transfer it to the apex court.

Congress ally in Tamil Nadu, the DMK, has also skipped the meeting despite the party and its president MK Stalin being vocal in its opposition to the citizenship law. Sources said that the party was angry due to remarks made by some local Congress leaders in Tamil Nadu.

The Aam Aadmi Party, too, has decided not to attend the meeting, presumably in face of Delhi elections next month where it is pitted against the BJP and the Congress.

Shivsena did not attend the meeting but clarified that it would not implement CAA in its present form in Maharashtra.

Miffed with the Congress and the Left over violence allegedly perpetrated by them in the state during the January 8 Bharat Bandh, Banerjee had decided to skip the meeting called by the president of the grand old party, Sonia Gandhi.

The 24-hour nationwide strike by central trade unions in West Bengal on Wednesday was marked by incidents of violence and arson, blocking of railway tracks and roads by protesters trying to enforce the shutdown.

BSP chief Mayawati tweeted that her party was boycotting the meet as the Congress had poached her MLAs in Rajasthan. Mayawati had dissolved the party’s executive in Rajasthan after its all six legislators joined the Congress.

Taking to Twitter, the former UP chief minister said: “By poaching BSP MLAs, the Congress has proved it is an unreliable party. This is a breach of trust even when the BSP was lending its unconditional support to the Congress government in Rajasthan.”

She added: “Instead of fighting with its arch rivals, the Congress always damages the parties that have helped and supported it. Hence, Congress is against Dalits, STs and OBCs and has been non-serious towards the rights of backwards.”

The BSP chief also accused the grand old party of being against the principles of Babasaheb Ambedkar, “which is why he had to resign from the post of the country’s first law minister”.

“The Congress never let Baba Saheb go to Lok Sabha and neither was he awarded the Bharat Ratna. This is very shameful and sad,” she said.

On Monday night, all six BSP MLAs wrote to state assembly Speaker CP Joshi to merge the legislative party with the Congress. MLAs Rajendra Singh Gudha, Jogendra Singh Awana, Wajib Ali, Lakhan Singh Meena, Sandeep Yadav and Deepchand said they were merging their legislative party with the Congress. “All the six BSP MLAs were in constant touch with Chief Minister Ashok Gehlot and today they have come into the fold of the Congress,” a Congress leader said.

“We took a decision in order to fight against communal forces and to work for the development of the state and stability of the government. Ashok ji is the best Chief Minister and no one can be better than him for Rajasthan. I was impressed with his style of working and polity,” news agency ANI quoted Udaipurwati lawmaker Rajendra Gudd.

Saying that it was difficult for them to support Congress from outside, Nadbai MLA Jogendra Singh Awana said, “We have given our resignations letter and also met CP Joshi ji and Ashok ji today. There were several challenges in front of us. On one hand, we were supporting Congress for the development of the state and on the other, we were fighting against them in elections. We all gave a thought to it. We took a decision in favour of the state.”

The Rajasthan Assembly has 200 seats. The Congress has 100 MLAs and its ally Rashtriya Lok Dal (RLD) has one MLA, giving it the majority to run the government. The Congress has also the outside support of 12 out of total 13 independent MLAs. Two seats are vacant.

In 2009, during Gehlot’s earlier tenure, all the six BSP MLAs had also defected to Congress. That time, the government was five short of a clear majority.
