the city civil court at Dindoshi observed while rejecting the actor’s plea for interim restraint on Brihanmumbai Municipal Corporation (BMC) from taking any action for demolishing all the modifications.

“I find that the plaintiff (Ranaut) being an owner of three flats converted these three units into one unit,” said the city civil court judge, LS Chavan, while rejecting Ranaut’s plea on December 17.

“She has covered the sunk area, duct area, common passage as per her own convenience and included FSI-free into habitable area. These are the grave violation of the sanctioned plan for which the permission of the Competent Authority is required,” the judge added in his order that became available on December 28.

FSI, or floor area ratio (FAR), is the maximum area that can be constructed on a piece of land.

The actor has filed a suit in the city civil court challenging a notice issued by BMC under section 53(1) of the MRTP Act and three orders passed by the Competent Officer of H/West ward, in May, September and December 2018. The directive was to remove the additions and alterations made at her residence, fifth floor of Orchid Breeze building at Khar west, and restore the three separate flats to their original condition, as per plans sanctioned by the civic body.

Ranaut had filed an application in the suit for interim injunction against BMC, restraining the civic body from taking any action pursuant to the notice under section 53(1).

Advocate Rizwan Siddiquee argued on her behalf that the notice and the orders were vague and did not specify the exact nature and description of the alleged unauthorised construction.

The Bombay High Court on Friday said the Brihanmumbai Municipal Corporation’s (BMC) action of demolishing a part of Kangana Ranaut’s bungalow smacks of malafide and was done to cause substantial loss to the actor.

The court also said it does not approve of authorities using “muscle power” against any citizen.

Reacting to the Bombay High Court’s ruling that the demolition carried out by the Mumbai civic body at actor Kangana Ranaut’s bungalow was illegal, Shiv Sena MP Sanjay Raut said the law should be equal for all.

The division bench of justice SJ Kathawalla and justice Riyaz Chagla held that the action of the civic body of demolishing about 40% of the bungalow was “actuated by malafide” and was in complete disregard of her rights.

The bench concluded that the civic action was a clear case of legal malice and was initiated after Ranaut’s infamous tweets, comparing Mumbai with Pakistan occupied Kashmir.

The high court also allowed Ranaut to take steps to make the bungalow habitable again. But, she will have to approach BMC and seek permission, if any permission is required for reconstruction of the demolished portion.

Ranaut approached high court on September 9, hours after the BMC demolished a part of her bungalow in the upscale Pali Hill area.

Apart from seeking that the demolition be declared illegal, the actor also sought Rs 2 crore from the civic body towards damages, claiming that several valuable articles were damaged by the civic body during the course of the demolition.

BMC had denied the allegations of malice and of any personal vendetta against the actor.

The civic body maintained that Ranaut had brazenly and unlawfully carried out extensive additions and alterations to the bungalow, in breach of its approved building plan.

It said that after being served a stop work notice under Section 354 (A) of the Mumbai Municipal Corporation Act, 1888, the actor submitted a false and evasive reply, because of which it had to take the next step of issuing a demolition notice and carrying out the demolition work.

In a two-part video message posted on her sister Rangoli Chandel’s Twitter, Kangana reiterated her allegation that the journalist had ridiculed and given her film Manikarnika bad press.

On Sunday, a film event she was at spiralled into an ugly argument with journalist Justin Rao who attempted to ask Kangana a question.

A journalists body has demanded that the actress apologise, failing which she would receive no media coverage.

In these two tweets, Kangana Ranaut says she won’t apologise to journalists who, she claims, are ‘ganging up’ against her and who are ‘on sale for Rs. 60.’ Some journalists, she said, have helped her in her journey up the ranks of Bollywood – but not these journalists.
