Delhi HC Seeks Harsher Penalties for Garbage Dumping in Drains

NEW DELHI: The Delhi High Court has asked the Municipal Corporation of Delhi (MCD) to consider increasing the ₹500 fine for throwing garbage into drains, observing that the current penalty is inadequate given its role in causing waterlogging during the monsoon. The Court directed the MCD to submit a proposal for enhancing the fine.

A Bench of Justice Prathiba M. Singh and Justice Manmeet Pritam Singh Arora expressed concern over the lack of civic sense among citizens, noting that countries such as Vietnam effectively manage heavy rainfall through better public discipline and coordinated civic action. The Court warned that it would not hesitate to take stringent action against those found dumping waste into drains.

The Court also directed the MCD, Delhi Jal Board, and Delhi Police to strengthen coordination for drain maintenance, sewage management, and enforcement against littering. It asked civic agencies to expedite work on covering open drains and ensuring stormwater drains remain functional before the onset of the monsoon. Court Can’t Direct Third Party : Delhi High Court trial court directing NBCC (India) Limited to deposit ₹1.48 crore in a fixed deposit receipt (FDR)

The Delhi High Court has held that a court cannot direct a third party to deposit money in court in the absence of an admitted or crystallised liability, reiterating that garnishee orders can ordinarily be passed only after a decree is obtained and the debt sought to be attached is established as due and payable. Justice Tejas Karia relied on Value Advisory Services v. ZTE Corporation (2009) where there was no decree in favour of the petitioner therein and the alleged debt was disputed by the garnishee. The High Court did not consider it appropriate to direct the garnishee to deposit the amount therein.

The Court was dealing with a challenge to a trial court order directing NBCC (India) Limited to deposit ₹1.48 crore in a fixed deposit receipt (FDR) in a commercial suit arising out of a payment dispute between a contractor and a subcontractor. The dispute stemmed from a project awarded by NBCC to GNC Infra LLP for construction works relating to a National Investigation Agency (NIA) facility in Hyderabad. LIVE Law

To Conduct Blood & Urine Test of Crew, Impractical For Airlines: Delhi High Court

The Delhi High Court has observed that there are sufficient precautionary measures in the Civil Aviation Requirements (CAR) to safeguard the crew members of aircrafts against “unfortunate false positive results” in breath analyzer tests.

Justice Gaurang Kanth added that the Requirements only imposes duty upon the airlines to conduct pre-flight breath analyzer tests and does not put any obligation upon such an airline to conduct blood and urine tests in case of positive results.

Pruning of trees in Delhi not allowed without permission of Tree Officer: Delhi High Court

The Court has set aside guidelines that had allowed the pruning of trees in Delhi with a girth of up to 15.7 cm without the permission of the Tree Officer.

The Delhi High Court recently made it clear that the permission of the Tree Officer in line with the Delhi Preservation of Trees Act, 1994 (DPT Act) is mandatory before pruning trees in Delhi regardless of the tree’s girth size [Prof Dr Sanjeev Bagai & Ors v Department of Environment Govt of NCT of Delhi & Ors].

To this end, the Court set aside guidelines that had allowed the pruning of branches of trees having a girth size of up to 15.7 cm without prior permission from the Tree Officer.
