Former union minister P Chidambaram spent the night at the Central Bureau of Investigation (CBI) in a cell which he had himself inaugurated as home minister in upa. he will be produced today in CBI court .

Chidambram was arrested after a dramatic arrest late on Wednesday from his house in south Delhi.

Mr Chidambaram was put up in “Lock-up suite 3” in the guest-house floor of the CBI building.

Sources say his questioning started this morning. Later in the day, cbi reportedly ask for maximum custody – 14 days – for his interrogation.

Mr Chidambaram is accused of facilitating foreign investment into a television company, INX Media, in 2007, when he was Finance Minister, at the instance of his son Karti Chidambaram, who allegedly received kickbacks. Sources say he will be confronted with files of the Foreign Investment Promotion Board, which Mr Chidambaram headed as minister.

Mr Chidambaram and his son were named by INX co-founders Peter and Indrani Mukerjea, who are currently in jail in connection with the murder of Indrani Mukerjea’s daughter Sheena Bora. Mr Chidambaram has denied the allegations, saying the case is a political witch-hunt by the BJP-led government.

Sources say the CBI may also confront the former minister with Indrani Mukherjea’s statement about meeting him over the deal.

In his petition before the top court on Wednesday, the former minister argued that his antecedents are “impeccable” and there is no possibility of him “fleeing from justice”. But his petition was not heard on technical grounds.

The Congress has rallied behind the senior leader, with Rahul Gandhi calling the investigative agencies’ pursuit of Mr Chidambaram a “disgraceful misuse of power” and his sister Priyanka Gandhi saying the former minister was being “shamefully hunted down”.

Madhya Pradesh chief minister Kamal Nath gave clarification that he had no connection with Puri’s business. Naths nephew Ratul Puri arrested for money laundering and bank fraud .

“I have no connection with the business they are doing. But it appears to be purely a mala fide action. I believe and have full faith that the court will take a corrective stand in this case,” Nath said on Tuesday.

Puri, former executive director of digital data storage company Moser Baer, is being investigated by three main central probe agencies — the Enforcement Directorate (ED), the CBI and the Income Tax department.

The ED officials said Puri was placed under arrest under the provisions of the Prevention of Money Laundering Act (PMLA) late Monday night.

In a statement released on Tuesday, Moser Baer called Puri’s arrest unfortunate. “The arrest by Enforcement Directorate is unfortunate. Moser Baer had operated in accordance with all legal compliances and this case now, when Moser Baer is in National Company Law Tribunal (NCLT), is motivated,” it said.

Besides Ratul and the company, his father and Managing Director Deepak Puri, Directors Nita Puri (Ratul’s mother and Kamal Nath’s sister), Sanjay Jain and Vineet Sharma were also been booked by the agency for alleged criminal conspiracy, cheating, forgery and corruption.

Ratul had resigned from the post of executive director in 2012, while his parents continue to be on the board, the bank said in a statement.

The company is involved in the manufacture of optical storage media like compact discs, DVDs, solid state storage devices. It was taking loans from various banks since 2009 and went for debt restructuring a number of times, the bank has alleged in the complaint which is now part of the CBI FIR.

When it was unable to pay the debt, a forensic audit was done and the account was declared as “fraud” by the Central Bank of India on April 20, 2019, it has alleged.

The Supreme Court on Monday granted two more weeks to the Central Bureau of Investigation (CBI) to complete the investigation into the road accident of Unnao rape survivor near Raebareli in Uttar Pradesh. The CBI had sought four-week time from the apex court to complete the probe, citing that the statements of the rape survivor and her lawyer were yet to be recorded.

The top court also directed Chief Minister Yogi Adityanath-led Uttar Pradesh government to pay Rs five lakh interim compensation to the lawyer of the Unnao rape survivor for medical expenses.

The CBI told the court that the lawyer continued to be in critical condition.

The Unnao rape survivor, along with two other women and her lawyer, was travelling on July 28 when her car met with an accident near Raebareli. Her aunt died in the accident while the rape survivor suffered serious injuries.

While the probe was initially initiated by the Uttar Pradesh, it was later transferred to the CBI. The UP Police filed a case of murder against prime accused in the case, expelled Bharatiya Janata Party (BJP) MLA Kuldeep Singh Sengar, and nine others.

The driver and the cleaner of the trust were arrested shortly after the incident and were later grilled by the agencies for possible clues.

Unnao rape survivor’s mother had alleged that the accident was an attempt to “eliminate” her daughter. Alleging foulplay in the accident, her family asked the Uttar Pradesh government to recommend a CBI probe.

The Unnao rape survivor was shifted to All India Institute of Medical Sciences (AIIMS) Trauma Centre in the national capital from Lucknow. She was placed on advanced life support system. A multidisciplinary team of doctors from critical care, orthopaedics, trauma surgery and pulmonary medicine is involved in her treatment.

The prime accused, Kuldeep Singh Sengar, a legislator from Bangermau in Unnao district, had allegedly raped the teenage girl at his residence in Unnao on June 4, 2017, where she had gone to seek a job. He was arrested by the CBI last year.

The Unlawful Activities (Prevention) Amendment Bill was passed in the Lok Sabha on Wednesday after a heated debate.

During a discussion on the Bill, Home Minister Amit Shah said tough laws were required to end terrorism and asserted that the amendment does not encroach on powers of states.

Replying to a spirited debate on the Unlawful Activities (Prevention) Amendment Bill, 2019 in the Lok Sabha, Shah said the BJP-led government will never misuse its provisions.

Congress and several opposition parties staged a walkout after the minister’s reply demanding that the Bill be sent to a standing committee.

Shah said the BJP-led government had only brought an amendment to the law which was enacted by Congress and whose provisions were later made stringent.

Shah said what Congress governments did “was right and what the BJP-led government is doing is also right”.

“The law was enacted in 1967 by a Congress government and amendments made to it in 2004, 2008 and 2013 when Congress was in power. Who made the law stringent? What you did was right, what we are doing is also right,” he said.

He asked opposition members about their concerns when the Congress had made changes to the law to make it stringent.

He said Congress member Manish Tewari had asked what was the need for tough laws and that terror-related problems were solved through political dialogue.

“There is a need for tough laws to end terrorism,” he said.

Referring to the provisions of the Bill that allow an individual to be designated as a terrorist, he said that terrorists often floats new organizations if a ban is imposed.

Shah also said that the BJP-led government was against “urban Maoism”.

“In this country, a lot of people involved in social work are working respectably, the police is not fond of catching them, but we don’t have any sympathy for those who work for Urban Maoism,” the Home Minister said.

“We have no sympathy for those who promote Maoism under an ideological shield,” he said.

The Supreme Court cracked down on all errant real estate companies, banks as well as public authorities, and issued a slew of directives.

Providing relief to the Amrapali home buyers in Uttar Pradesh’s Noida and Greater Noida, the top court handed over all pending projects to the National Buildings Construction Corporation Limited (NBCC). As many as 42,000 flats are awaiting completion in various Amrapali projects.

The court cancelled registration of Amrapali under RERA, thereby banning the real estate company from undertaking any housing project even in future.

A bench headed by Justice Arun Mishra held that Noida and Greater Noida authorities were complicit as builders played a fraud upon the home buyers and siphoned off their money by diverting it to create personal assets of the Amrapali CMD and directors.

The court held that these authorities cannot be allowed to now receive their outstanding loan to Amrapali from these home buyers.

“They have been defrauded once and this court cannot allow them to be defrauded all over again,” said the bench as it added that even bankers cannot extract their loans from the home buyers.

According to the bench, also comprising Justice Uday U Lalit, the home buyers will pay only towards completion of their houses and they cannot be burdened with the loans Amrapali owed either to the authorities or the banks. It said that they can recover only from the assets of the Amrapali functionaries that stand attached under the orders of the court.

The bench further ordered an investigation by the Enforcement Directorate into the aspect of money laundering. It asked ED to submit periodic reports of investigation in the court.

The bench fixed August 9 as the next date of hearing.

The apex court also expanded the ambit of the petitions by the aggrieved home buyers of Amrapali, and directed the central government to take stock of pending housing development projects across all states.

The Supreme Court said today Karnataka assembly Speaker is free to decide on the status of rebel lawmakers whose resignations endanger the ruling Congress-Janata Dal Secular coalition.

“The discretion of the Speaker should not be fettered by any direction from the court. The Speaker can decide on the resignations as and when he feels appropriate,” the top court said, but added that his decision should be submitted to the court.

The court also said the rebel lawmakers should not be compelled to participate in the proceedings of the state assembly. This means the government cannot use whips to force the dissident lawmakers to participate in the trust vote on Thursday.

The court said: “We have to maintain constitutional balance.”

The rebels had argued in court yesterday that their resignations must be accepted by the Speaker, that they could not be “forced to attend the assembly”.

Sixteen legislators of the JDS-Congress coalition and two independent lawmakers have resigned over the past two weeks.

If the resignations are accepted, the state government will lose its majority. The coalition’s 118 members will come down to 100 and the majority mark will drop from 113 to 105. The BJP has 105 members and the support of the two independents, which would take its tally to 107.

Speaker KR Ramesh Kumar had told the court that many of the dissidents were facing disqualification and he needed time to examine their resignation letters. He had also said he had to determine whether the resignations were coerced.

If the MLAs are disqualified, they must be re-elected and can’t become ministers. A resignation, on the other hand, allows lawmakers to become ministers easily if the BJP comes to power. They will have six months to seek re-election.

The rebels, who have been staying in a hotel in Mumbai after resigning on July 6, had gone to the Supreme Court accusing the Speaker of sitting on their resignations to buy time for the shaky coalition.

Karnataka Chief Minister HD Kumaraswamy had backed the Speaker, arguing that rebel lawmakers were “hunting in pack” to destabilize his government and their resignations must be reviewed carefully.

MUMBAI police imposed Section 144, which prohibits assembly of more than four people at one place in Powai Police station limits with effect from July 9 to July 12 because of “likelihood of breach of peace and disturbance of public tranquility”

Eight MLAs from Karnataka, who flew to Mumbai three days ago after quitting the state’s Assembly are still camping here.
The legislators were earlier on their way to Goa accompanied by a BJP leader, but cut short the trip and returned to Mumbai. The two Independent MLA-ministers, H Nagesh and R Shankar, who withdrew support on Monday in a further blow to the government are also reported to be in Mumbai.

The Congress rushed senior leaders Ghulam Nabi Azad and BK Hariprasad to Bengaluru to help defuse the crisis amid reports that some more MLAs including Sowmya Reddy, daughter of rebel Congress leader and party veteran Ramalinga Reddy, may join the dissident ranks.

The fate of the 13-month-old JD(S)-Congress government led by Chief Minister HD Kumaraswamy is hinged on the Speaker’s decision on the resignation of the 14 MLAs, including MLA R Roshan Baig who joined the bandwagon of dissidents on Tuesday. A total of 13 MLAs, 10 of the Congress and 3 of the JD(S), submitted their resignation to the Speaker’s office on Saturday triggering a fresh political crisis.

Congress leader Rahul Gandhi was issued summonses by two Gujarat courts in criminal defamation complaints, filed by BJP leaders for allegedly calling Union Minister Amit Shah a “murder accused” and saying that “all thieves have Modi as surname”.

Chief Judicial Magistrate B H Kapadia in Surat asked Gandhi to appear on July 16, while an Ahmedabad court ordered the Congress leader to appear on August 9.

In both the cases, the courts issued summonses holding that on the face of it there was a case of criminal defamation against Gandhi under Section 500 of the Indian Penal Code.
MANY DEFAMATION CASES
Rahul Gandhi is facing several cases of defamation. Last week, he appeared in courts in Mumbai and Patna and was granted bail. He had alleged that the cases were filed by his political opponents to “harass and intimidate” him.
BJP MLA COMPLIANT
The Surat court was on hearing a complaint of BJP legislator Purnesh Modi who alleged that the Congress leader had defamed the entire Modi community with his remark that “how come all thieves have Modi as common surname” made during the Lok Sabha campaign.
