<h2>10 Additional Judges elevated to become Judges of Bombay High Court<br />
<span id="ltrSubtitle"></span></h2>
<p>The President of India, in exercise of the power conferred by clause (1) of Article 217 of the Constitution of India, appointed S/Shri Justices Avinash Gunwant Gharote, Nitin Bhagawantrao Suryawanshi,  Anil Satyavijay Kilor, Milind Narendra Jadhav, Mukund Govindrao Sewlikar, Virendrasingh Gyansingh Bisht, Debadwar Bhalchandra Ugrasen,  Smt. Mukulika Shrikant Jawalkar, Surendra Pandharinath Tavade, and  Nitin Rudrasen Borkar, Additional Judges of the Bombay High Court, to be Judges of the Bombay High Court. A notification in this regard was issued by Department of Justice, Ministry of Law&amp; Justice today.</p>
<p>Shri Justice Avinash Gunwant Gharote, B.Sc., LL.B., was enrolled as an Advocate on 23.10.1986. He practiced before the Bombay High Court at Nagpur Bench in Civil, Arbitration, Constitutional and Criminal matters. His specialization was in Civil and Arbitration laws. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 23.08.2019. His term as an Additional Judge will expire on 22.08.2021.</p>
<p>Shri Justice Nitin Bhagawantrao Suryawanshi, B.S.L., LL.B., was enrolled as an Advocate on 05.08.1988. He practiced before the Bombay High Court at Aurangabad Bench in Civil, Criminal, Constitutional, Labour, Service etc. matters. His specialization was in Criminal and Constitutional laws. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 23.08.2019. His term as an Additional Judge will expire on 22.08.2021.</p>
<p>Shri Justice Anil Satyavijay Kilor, B.Com., LL.B., was enrolled as an Advocate on 25.06.1992. He practiced before the Bombay High Court at Nagpur Bench in Civil, Criminal, Constitutional, Labour and Service matters. His specialization was in Constitutional and Service Laws. He served as Assistant Government Pleader and Additional Public Prosecutor, High Court at Nagpur Bench from 2000-2005. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 23.08.2019. His term as an Additional Judge will expire on 22.08.2021.</p>
<p>Shri Justice Milind Narendra Jadhav, B.Sc., LL.M., was enrolled as an Advocate on 10.02.1998. He practiced before the Supreme Court of India, Bombay High Court and Subordinate Courts/Tribunals in Bombay in Civil, Constitutional, and Land matters. His specialization was in Land Acquisition, Writ Petitions &amp; Land Revenue and Town Planning cases. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 23.08.2019. His term as an Additional Judge will expire on 22.08.2021.</p>
<p>Shri Justice Mukund Govindrao Sewlikar, B.Com., LL.B., was born on 21.09.1960 and enrolled as an advocate on 03.09.1984. He joined the Judicial Service on 10.10.1990. He served as Judicial Officer in various courts in Maharashtra State. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 05.12.2019. His term as an Additional Judge will expire on 04.12.2021.</p>
<p>Shri Justice Virendrasingh Gyansingh Bisht, B.Sc., LL.B., M.I.R.P.M. (Master of Industrial Relation and Personal Management) was enrolled as an Advocate on 29.11.1985. He joined the Judicial Service on 10.08.1990. He served as Judicial Officer in various courts in Maharashtra State. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 05.12.2019. His term as an Additional Judge will expire on 04.12.2021.</p>
<p>Shri Justice Debadwar Bhalchandra Ugrasen, B.Com., LL.B., enrolled as an Advocate on 03.07.1985. He joined the Judicial Service on 21.05.1992. He served as Judicial Officer in various courts in Maharashtra State. He was appointed as Additional Judge, Bombay High Court with effect from 05.12.2019. His term as an Additional Judge will expire on 16th June, 2021 i.e. his date of superannuation.</p>
<p>Smt. Justice Mukulika Shrikant Jawalkar, M.Com., LL.B. &amp; LL.M, enrolled as an Advocate on 21.09.1989. She joined the Judicial Service on 02.05.2008. She served as Judicial Officer in various courts in Maharashtra State. She was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 05.12.2019. Her term as an Additional Judge will expire on 04.12.2021.</p>
<p>Shri Justice Surendra Pandharinath Tavade, B.Com., LL.B., enrolled as an Advocate on 12.07.1984. He joined the Judicial Service on 03.09.1990. He served as Judicial Officer in various courts in Maharashtra State and as Registrar, Original Side, Inspection-I and as Registrar General, Bombay High Court. He was appointed as Additional Judge, Bombay High Court for a period of 2 years with effect from 05.12.2019. His term as an Additional Judge will expire on 04.12.2021.</p>
<p>Shri Justice Nitin Rudrasen Borkar, LL.B., was enrolled as an advocate on 08.08.1995. He joined the Judicial Service on 02.05.2008. 										<content:encoded><![CDATA[<p>The Mapusa District and Sessions Court in Goa on May 21 acquitted former <em>Tehelka</em> editor Tarun Tejpal in a 2013 sexual harassment and rape case filed by his colleague.</p>
<p>Mr. Tejpal was accused of raping his colleague in an elevator of a five-star hotel. He was arrested on November 30, 2013, by the Goa Crime Branch and was granted bail on July 1, 2014, by the Supreme Court.</p>
<p>In February 2014, the Goa Crime Branch filed a 2,846-page chargesheet against Mr. Tejpal.</p>
<p id="1" class="story_para_1">Tejpal describing it as “a long-fought for vindication&#8221; in a statement read out by his daughter Cara outside the court in Goa.</p>
<p id="2" class="story_para_2">“In November 2013 I was falsely accused of sexual assault by a colleague. Today the Hon’ble Trial Court of  Additional Sessions Judge Kshama Joshi, in Goa, has honourably acquitted me. In an awfully vitiated age, where ordinary courage has become rare, I thank her for standing by the truth,&#8221; Tejpal said.</p>
<p id="3" class="story_para_3">A sessions court in Goa had adjourned the hearing on Wednesday and posted it for May 21 due to lack of staff in wake of the coronavirus pandemic. On Wednesday, Tejpal was present in the court along with some of his family members and lawyers.</p>

<p>Special judge Kshyama Joshi pronounced the judgment, and the reasons for acquittal will be known in due course of time.</p>
<p>On September 29, 2017, the court framed charges against him under various Sections of the Indian Penal Code.</p>
<p>The trial commenced in March 2018 but got interrupted due to several factors, one of them being Mr. Tejpal seeking a discharge in the case, for which he first moved the sessions court, then the High Court and later the Supreme Court.</p>
<p>In August 2019, the top court declined his plea and ordered that the trial be held in-camera (not open to the public) and be completed in six months.</p>
<p>The trial finally began on December 7, 2020, and the survivor was examined and cross-examined for an entire month till January 7, 2021, by physical appearance and through video-conferencing.</p>
<p>The prosecution examined 71 witnesses and the defense had four witnesses, including family members of both the accused and the survivor. The trial concluded at the end of February 2021 and, after final arguments were made by both sides, the judgment was reserved.</p>

Attorney General KK Venugopal, who was representing the government, said he get back to the court on the issue after discussion.</p>
<p>&#8220;We make it clear that we recognize the fundamental right to protest against a law. There is no question of balancing or curtailing it. But it should not damage anyone&#8217;s life or property,&#8221; said Chief Justice SA Bobde.</p>
<p>Justice Bobde, who said yesterday that the matter must be handed over to a committee, said it must have &#8220;independent members with knowledge of agriculture and hear both sides and give report on what is to be done&#8221;.  Meanwhile, the &#8220;protests can continue without violence and the police will not do anything (to stop the protests),&#8221; the Chief Justice said.</p>
<p>Senior advocate Harish Salve, who was representing one of the petitioners, said &#8220;Protests cannot be just for protest, but to articulate point of view,&#8221; the court said, &#8220;That is exactly what we mean&#8221;</p>

<p>Thousands of farmers angered by three agricultural laws that they say threaten their livelihoods have intensified their protests by blocking highways and camping out on the outskirts of the capital New Delhi.</p>
<p>Petitioners had approached the Supreme Court to complain that the protests had hampered drivers and making it difficult for people to access emergency medical services.</p>
<p>&#8220;We are of the view at this stage that the farmers&#8217; protest should be allowed to continue without impediment and without any breach of peace either by the protesters or the police,&#8221; Bobde said.</p>
<p>Prime Minister Narendra Modi&#8217;s administration in September introduced the farm bills that the government says will unshackle farmers from having to sell their produce only at regulated wholesale markets and make contract farming easier.</p>
<p>Farmers insist that the new laws will leave them at the mercy of big corporations.</p>
<p>Six rounds of talks between government ministers and farmers&#8217; union leaders have failed to resolve the situation.</p>
<p>The government has said while the laws can be amended, it is against repealing the bills. Farmers last week rejected a government&#8217;s proposal to amend the legislation.</p>

<p>The court has, however, allowed the government to go ahead with the ground-breaking ceremony and complete the paperwork related to the project. The top court’s nod comes  before Prime Minister Narendra Modi is scheduled to lay the foundation stone for a new Parliament building that was proposed as part of the mega project on Thursday, December 10. The building is estimated to cost Rs 971 crore.</p>
<p>A bench of Justices AM Khanwilkar, Dinesh Maaheshwari and Sanjiv Khanna held a special hearing in the case &#8211; it has already reserved its verdict on the petitions against the project &#8211; and indicated their displeasure to Solicitor General Tushar Mehta at reports that the agencies had started work on the ground before their ruling.</p>

<p>“It should not be a fait accompli presented to the court…. Stop at the foundation laying ceremony. Some deference must be shown to the court,” the bench observed.</p>
<p>Solicitor General Tushar Mehta told a bench headed by Justice A M Khanwilkar that there would be only foundation stone-laying ceremony, and no construction, demolition or felling of trees would be done for the project as of now.</p>
<p>The revamp, which was announced in September last year, envisages a new triangular Parliament building, with seating capacity for 900 to 1,200 MPs, that is targeted to be constructed by August, 2022 when the country will be celebrating its 75th Independence Day.</p>
<p>The common Central Secretariat is likely to be built by 2024.</p>
<p>Prime Minister Narendra Modi will lay the foundation stone on December 10 for the new Parliament building and the construction is expected to be completed by 2022 at an estimated cost of Rs 971 crore, Lok Sabha Speaker Om Birla had said on December 5.</p>
<p>The top court is seized of pleas which have raised questions over several aspects, including the environmental clearance granted to the project.</p>
<p>During the hearing conducted on Monday through video-conferencing, the bench asked Mehta to apprise it within five minutes about the government&#8217;s view on the issue of construction work for the project.</p>
<p>The bench observed that it would not allow construction or demolition till its decision on the pending pleas opposing the project.</p>
<p>The top court said the Centre can proceed with the requisite paperwork in the meantime.</p>
<p>On November 5, the apex court had reserved its verdict on a batch of pleas which have raised questions over the Centre&#8217;s ambitious Central Vista project, which covers three km stretch from Rashtrapati Bhavan to India Gate in Lutyens&#8217; Delhi.</p>
<p>The solicitor general had earlier argued in the top court that the project would &#8220;save money&#8221; which is paid as rent for housing central government ministries in the national capital.</p>

										<content:encoded><![CDATA[<p>Comedians <a href="https://www.india.com/topic/bharti-singh/">Bharti Singh</a> and <a href="https://www.india.com/topic/haarsh-limbachiyaa/">Haarsh Limbachiyaa</a> were arrested by the Narcotics Control Bureau this weekend and sent to 14-day judicial custody by a special holiday court on Sunday.</p>
<p>The court refused to agree to the NCB’s demand in which they had asked for remand custody of the two actors and said that it was a simple case of consuming a small quantity of drugs, and therefore, no custody is required.</p>
<p>the court observed, “The drug seized from their residence is of a small quantity. Also, it’s a case of consumption only, hence police custody under such circumstances is not required.</p>
<p>Bharti and Haarsh have been sent to different prisons. While she’s in the Byculla women’s prison, her husband is at the Taloja jail.</p>
<p>comedian Raju Srivastava refused to believe the news when it came out initially.</p>
<p>He speaks to us, “I have worked with her in Comedy Circus, Raju Haazir Ho and Gangs of Haseepur, and many live shows too. Usko dekh ke kabhi nahi laga ki drugs leti hogi. I had attended her wedding too. I would get curious as to how her friends, like Sunil Grover, Krushna (Abhishek), could dance all night, not sleep, and then the next day again have fun and dance. I would think why don’t they feel the need to sleep, and yes I know they are younger than me maybe that’s why they have the energy. Lekin ab har cheez pe doubt jaa raha hai jabse news aayi hai.”</p>
<p>The 56-year-old adds that he dismissed her arrest initially as fake news, but when it was confirmed he was shocked and sad.</p>
<p>Meanwhile, Maharashtra cabinet minister Nawab Malik slammed the agency by saying that it was targeting Bollywood and arresting the addicts instead of sending them to rehab.</p>
<p>While Bharti was arrested earlier, post a long interrogation on Sunday morning, the NCB arrested Harsh as well. The agency had seized small quantities of Ganja from their premises. On Sunday, the duo was produced before the holiday court in South Bombay and sent to judicial custody. &#8220;We had sought two days custody to understand how they purchased the drugs and how payments were made to the peddler, but the court refused it,&#8221; said advocate Atul Sarpande, who appeared for NCB.</p>

<p>As many as 34 top Bollywood producers and four film industry associations Monday filed a lawsuit in the Delhi High Court, seeking to restrain television channels from making “irresponsible, derogatory and defamatory remarks” against the Hindi film industry.</p>
<p>The suit has been filed against <em>Republic TV’s</em> Editor-in-Chief Arnab Goswami and journalist Pradeep Bhandari of the channel, and <em>Times Now’s </em>Editor-in-Chief Rahul Shivshankar and its prominent anchor Navika Kumar as respondents.</p>
<p>The production companies include those run by Salman Khan, Aamir Khan, Shah Rukh Khan, Karan Johar, Farhan Akhtar and Ajay Devgn.</p>

<p>They have been assailed for conducting media trials of Bollywood personalities and interfering with the right to privacy of persons associated with the film industry, in the wake of Sushant Singh Rajput’s death and the subsequent arrest of his girlfriend <a href="https://theprint.in/india/i-am-innocent-being-subjected-to-witch-hunt-says-rhea-chakraborty-in-bail-plea/508807/">Rhea Chakraborty</a>.</p>
<p>“The livelihood of persons associated with Bollywood is being severely impacted by the smear campaign being run by the defendants. This is in addition to the ongoing pandemic which has resulted in extreme revenues and work opportunity loss,” reads the suit filed by the law firm DSK Legal.</p>
<p>“The privacy of the members of Bollywood is being invaded, and their reputations are being irreparably damaged by painting the entire Bollywood as criminals, seeped in drug culture, and making being part of Bollywood as synonymous with criminal acts in the public imagination.”</p>

										<content:encoded><![CDATA[<p>Vinay Sharma was injured after he reportedly banged his head against the wall of his cell at Tihar jail in Delhi. he is One of the four Nirbhaya case convicts to be hanged on March 3,</p>
<p>A jail official was quoted that Vinay Sharma had attempted to hurt himself by banging his head against a wall on Sunday and had suffered minor injuries.</p>
<p>Earlier this week, Vinay Sharma&#8217;s lawyer had told a Delhi court that he was on a &#8220;hunger strike&#8221; and his mental status was not good.</p>
<p>The court on Monday put out a third death warrant for Vinay Sharma, along with Akshay Thakur, Pawan Gupta and Mukesh Singh, the men convicted in 2012 gang-rape of a young medical student who was assaulted and tortured so brutally that she died days later.</p>
<p>Two previous dates of hanging &#8211; January 22 and February 1 &#8211; came and went as the convicts filed multiple petitions to stall the execution. On February 5, the Delhi High Court ordered that all four would have a week to exhaust all their legal remedies, including mercy petitions to the President, and said they cannot be hanged separately.</p>
<p>A special public prosecutor told the court that three of the convicts were done with their legal options and there is no petition pending in any court.</p>
<p>On the third date of hanging, Nirbhaya&#8217;s mother said: &#8220;I hope that this date is final. Anybody is given an opportunity for remedy only for a limited number of times. These four convicts have been given enough opportunities now. Our struggle will end on March 3 when these convicts will be hanged.&#8221;</p>
<p>Six men, including one just short of 18, were arrested after the December 16, 2012 gangrape. One of the main accused, Ram Singh, was found hanging in his jail cell. The teen was released after three years in a reform home.</p>

										<content:encoded><![CDATA[<p>Lucknow court blast: Two lawyers were injured during an explosion at the Lucknow court on Thursday afternoon.</p>
<p>A bomb explosion has been reported at a court complex in Lucknow on Thursday, media reports said. At least two lawyers are feared injured in the explosion. The Wazirganj police have reached the spot and are probing the incident. Three more crude bombs have been recovered from the court complex by the local police, reported news agency ANI.</p>
<p>The explosion was reported during a scuffle between a group of lawyers, India Today TV reported. One of the lawyers, speaking to reporters, claimed that the attack was directed at him and called for the removal of “unruly elements” from the court premises.</p>
<p>The explosion has resulted in huge chaos and lawyers have demanded that the culprits be arrested.</p>

<p>All the accused including Honeypreet appeared before the court of Chief Judicial Magistrate of Panchkula. Charges were framed during the hearing. Honeypreet, appearing on bail, appeared in court for the first time. After hearing in the court December 13 is fixed as next date for arguments .</p>
<p>Honeypreet was granted bail by the CJM court on 6 November. Earlier, on November 2, the court removed the sedition section from 15 accused including Honeypreet in this case.</p>
<p>The Panchkula court has framed charges against the number 2 accused under sections 216, 145, 150, 151, 152, 153 and 120 B of the IPC. There is a case of FIR 345 filed in the case of riots in Panchkula on 25 August 2017.</p>
<p>when Honeypreet was lodged in Ambala Jail in judicial custody as an accused, she used to appear in court through video conferencing. But now she has got bail after the removal of the sedition section and she will have to appear physically in the court on every date till the court .</p>
<p>the police took Honeypreet out of the court under security cover. On the other hand, the people of the camp were also making security circles around Honeypreet and her car.</p>
<p>At the same time, defense lawyer Suresh Rohila said that all the accused except the three accused appeared in the court. The lawyer said that the charges have been framed on the accused and the trial will begin on that.</p>

										<content:encoded><![CDATA[<p><span class="mceItemHidden">A Delhi Court has admitted a plea filed by the parents of <span class="hiddenSpellError">2012-gangrape</span> victim, seeking transfer of the case to another judge.</span></p>
<p><span class="mceItemHidden">The victim&#8217;s parents have sought court&#8217;s direction to <span class="hiddenSpellError">Tihar</span> Jail authorities to speed up the execution of the rape convicts.</span></p>
<p>The court will hear the matter on November 25.</p>
<p>They moved the application since the earlier two judges hearing the matter got transferred and the matter is getting adjourned continuously, the plea said.</p>
<p><span class="mceItemHidden">The special fast track court, set up to hear cases of sexual harassment cases exclusively, of Patiala House Court is now vacant and no judge has been appointed till now.</span></p>
<p>The application said that victim&#8217;s parents approached the court since the convicts have exhausted all legal remedies.</p>
<p><span class="mceItemHidden">In December last year, the parents of <span class="hiddenSpellError">Nirbhaya</span>, the 23-old paramedic who was gang-raped in December 2012, approached the court to fast-track the procedure to hang all four convicts in the case.</span></p>
<p><span class="mceItemHidden">Supreme Court on December 12, 2018, dismissed the PIL seeking a direction to the Centre to execute the death penalty awarded to four convicts &#8212; <span class="hiddenSpellError">Mukesh</span>, <span class="hiddenSpellError">Pawan</span>, <span class="hiddenSpellError">Vinay</span> and <span class="hiddenSpellError">Akshay</span> &#8212; in the sensational <span class="hiddenSpellError">Nirbhaya</span> <span class="hiddenSpellError">gangrape</span> and murder case.</span></p>
