क्या है नागरिकता संशोधन अधिनियम –
देश के दोनों सदनों में 4 साल पहले पास होने के बाद अंततः केंद्र सरकार द्वारा नागरिकता संशोधन अधिनियम CAA  नियमों की अधिसूचना जारी कर दी गई है। केंद्रीय गृह मंत्रालय ने 11 मार्च 2024 को शाम 6:00 बजे CAA के नियमों को लेकर अधिसूचना जारी की। लोकसभा चुनाव से ठीक पहले नागरिकता संशोधन अधिनियम नियमों की अधिसूचना जारी करने की घोषणा केंद्र सरकार का बहुत बड़ा फैसला है। इसके लिए पोर्टल भी तैयार है, जिसके जरिए गैर मुस्लिम प्रवासी समुदाय के लोग नागरिकता पाने के लिए आवेदन कर सकेंगे। केंद्रीय गृह मंत्रालय द्वारा इसके लिए पूरी तैयारी कर ली है।

क्या कहती है वेबसाइट पर सीएए के लिए जारी सुचना –

भारतीय नागरिकता का अधिग्रहण –
– नागरिकता संशोधन अधिनियम 2019 के तहत भारतीय नागरिकता के लिए आवेदन करने के लिए एक विशेष प्रावधान मौजूद है।
– यह विशेष रूप से उन कुछ व्यक्तियों के लिए है जो 31 दिसंबर, 2014 को या उससे पहले भारत में प्रवेश कर चुके हैं और पाकिस्तान या अफगानिस्तान या बांग्लादेश के हिन्दू या सिख या बौद्ध या जैन या पारसी या ईसाई समुदाय से हैं।
– अधिक विस्तृत जानकारी के लिए, व्यक्ति 1955 के नागरिकता अधिनियम में उल्लिखित प्रावधानों का संदर्भ ले सकते हैं।
– आवेदन जमा करने के इच्छुक व्यक्तियों के पास अपना ईमेल आईडी और मोबाइल नंबर होना चाहिए।
– आवेदक सीएए 2019 के तहत भारतीय नागरिकता के लिए आवेदन जमा करने के लिए बटन पर क्लिक कर सकते हैं और अपने व्यक्तिगत ईमेल आईडी और मोबाइल नंबर का उपयोग करके लॉग इन कर सकते हैं।

इन छह समुदायों ( हिन्दू, सिख,बौद्ध,जैन, पारसी, ईसाई) पर अगर कोई भी क़ानूनी करवाई चल भी रही होगी तो अब नहीं चलेगी जैसे विदेशी अधिनियम – 1946 एवं पासपोर्ट अधिनियम – 1920 के तहत सजा हो सकती थी, जो अब नहीं होगी।

यह किसी की नागरिकता छीनने का नहीं बल्कि नागरिकता देने का कानून है। –

आखिर जब ये कानून (हिन्दू, सिख,बौद्ध,जैन, पारसी, ईसाई) जो पाकिस्तान या अफगानिस्तान या बांग्लादेश में अल्पसंख्यक के रूप में पीड़ित या यूँ बोले सताएं गए अल्पसंख्यक थे, उनको नागरिकता दी जा रही है फिर हंगामा क्यों मचा है। विरोध करने वालों का कहना है की ये कानून भेद भाव पैदा करता है। क्योकि इसमें नागरिकता देने के प्रावधान में मुस्लिमों को शामिल नहीं किया गया है। क्या पाकिस्तान या अफगानिस्तान या बांग्लादेश में मुस्लिम अल्पसंख्यक है या पीड़ित हैं तो जवाब है “नहीं। यह सिर्फ एजेंडाधारियों के द्वारा लोगों को गुमराह किया जा रहा है। सुप्रीम कोर्ट में इस कानून को रद्द करने के लिए बहुत सारी याचिकाएं भी दायर की गई हैं।

नागरिकता संशोधन अधिनियम में पहले से ही नागालैंड, अरुणाचल प्रदेश, त्रिपुरा, मणिपुर, मिजोरम एवं मेघालय के लगभग सभी हिस्सों एवं असम के आदिवासी क्षेत्रो को इससे दूर रखा गया है।

अब जब सीएए लागू हो गया है तो मतुआ समुदाय इसके लिए खुशियां मना रहा है क्योंकि मतुआ समुदाय की यह लंबे समय मांग चली आ रही थी, अब जाके उन्हें नागरिकता मिलेगी। हिंदू शरणार्थी, अनुसूचित जाति या दलित समुदाय के रूप में वर्गीकृत, मतुआ समुदाय विभाजन के बाद दशकों से  बांग्लादेश (तत्कालीन पूर्वी पाकिस्तान) से किसी तरह जान बचाकर वहां से भाग आये थे, और वे बंगाल की दूसरी सबसे बड़ी अनुसूचित जाति वाली आबादी हैं, जो अधिकतर उत्तर और दक्षिण 24 परगना में प्रवास करते हैं। इनका प्रभाव  नादिया, हावड़ा, कूच बिहार, उत्तर और दक्षिण दिनाजपुर और मालदा जैसे सीमावर्ती जिलों में है। इनकी संख्या लगभग 1.5 करोड़ हैं, जो उत्तर बंगाल में राजबंशियों के बाद दूसरा सबसे बड़ा है। राज्य की 42 लोकसभा सीटों में से, बंगाल में 10 सीटें अनुसूचित जाति के लिए आरक्षित हैं, जिनमें से भाजपा ने 2019 लोकसभा चुनाव में चार – कूचबिहार, जलपाईगुड़ी, बिष्णुपुर और बोनगांव पर जीत हासिल की थी। इनकी नागरिकता के बाद चुनाव में एक बहुत बड़ा उलटफेर देखने को मिल सकता है।

“Mamata will pay dearly for opposing the Citizenship Amendment Act. People will make her political refugee in the state,” Shah said. He was addressing virtual rally for Bangal election .

Shah added that the CAA was an important step to put a stop to appeasement politics. “People of Bengal should know this. It was a step to end the wrongs done for decades to refugees.”

Shah said he remembers how Mamata was furious when the CAA was implemented and had opposed the decision in the Parliament and on the streets.

“I have never seen such an angry person before. Mamata ji don’t you think people from the Matua and Namashudra community should get citizenship? If yes, then why you are so angry?” Shah asked.

Mounting an attack over the issue of trains for migrant workers, the home minister said: “Bengal has asked for the fewest trains, only 236 trains which have transported three lakh migrants. You (Mamata Banerjee) have called Shramik Special trains Corona Express. That will pave the way for your exit.”

Shah added that Banerjee was stalling Ayushman Bharat and other central schemes because she is wary of Narendra Modi’s increasing popularity in the state.

“I ask her why is she not allowing health benefits to reach the people of Bengal? There is a limit to such politics which comes at the cost of well being of people. All state leaders, including Kejriwal, have accepted the scheme, but Mamta has not,” Shah said.

“I assure people of Bengal that we will implement the scheme after we win the state elections,” the home minister said.

He remarked that he still remembers how opposition parties and leaders, including Rahul Gandhi criticised the Jan Dhan bank accounts. “It is through these accounts that 51 crore people have received direct financial benefits in the time of coronavirus pandemic,” Shah added.

Asking people of Bengal how political violence could become “the state’s identity”, he said that the chief minister should stop “resorting to violence.”

“Can Mamata stop change by resorting to violence? You try to stop us by stopping us on roads and refusing helicopters. Now we are addressing Bengal’s people through the virtual mode, how will you stop us?” Shah asked.

Accusing the state government of being “steeped in corruption”, Shah said that he has lost count of the number of corrupt activities the TMC government has been accused of.

Shah said that the BJP would realize Bengal’s dream of transforming into ‘Sonar Bangla’ (Golden Bengal). “BJP deserves one chance in Bengal. We will put an end to political violence, corruption, appeasement politics, unemployment and dynastic rule.”

Earlier, the BJP’s state unit had prepared a ‘nine-point agenda’ highlighting the nine major failures of the Mamata Banerjee government in the state which has been in power for nine years.

The BJP has launched a mega drive of virtual rallies from various parts of the country. Top Union Ministers will reach out to people through social media and digital platforms to highlight the achievements of the Narendra Modi government that completed its first year of second term on May 30.

They said 2,193 people have been either detained or arrested in connection with the riots. Of them, 50 have been arrested on charges under the Arms Act.

Meanwhile, a 27-year-old man was arrested for allegedly being involved in another man’s death during the violence. The crime branch, probing the murder cases registered during the riots, arrested Shahnawaz for allegedly killing Dilbar Singh Negi, 20, and is trying to identify other suspects in the case.

Negi’s, whose decapitated and charred body was found in Brahmpuri on 26 February, had come to the National Capital six months ago from Uttarakhand’s Pauri Garhwal and worked at a sweet shop in northeast Delhi.

A Delhi court allowed police three more days’ custodial interrogation of Shahrukh Pathan, who allegedly pointed a gun at an unarmed police head constable during the riots in Maujpur.

Pathan, 23, whose photograph pointing a gun at head constable Deepak Dahia had gone viral on social media, was arrested on Tuesday from Uttar Pradesh’s Shamli district.

The pistol he pointed at Dahia was recovered from his home in northeast Delhi’s Ghonda. In a viral video, Pathan was seen pointing his pistol at the policeman on Jaffrabad-Maujpur road on 24 February. After opening fire in the air, he kept the pistol at his residence and fled from the city in a car.

Police said after seeing himself on TV news channels, Pathan changed his clothes and fled to Punjab. He then moved to Bareilly in Uttar Pradesh before hiding at a friend’s residence in Shamli in the state.

Uttar Pradesh police said they have arrested an alleged drug trafficker suspected to have helped Pathan escape from Delhi after the riots. Kaleem, 28, was wanted by the Narcotics Cell of Delhi police in a cannabis smuggling case.

Addressing a press conference, Additional Commissioner of Police (Crime Branch) AK Singhla said Pathan, 23, fled to Punjab after his video was widely circulated on social media and shown on news channels. Later, he hid at a friend’s house in Shamli, he added.

Based on information received and extensive discreet inquiries conducted in different parts of Delhi and UP, the police zeroed in on the area around Shamli and Kairana, Singhla said.

On the intervening night of Monday and Tuesday, police received information that Pathan would be coming to Shamli bus stand between 10 am and noon to meet someone, he said. A trap was laid and he was arrested, the officer added.

“He (Shahrukh) was planning to flee Shamli but was nabbed and later brought to Delhi,” Singhla said. “We are trying to recover the pistol used by him during the violence. He was fond of buying pistols. He had procured a 7.65 mm pistol and ammunition about two years ago from one of his (factory) labourers.”

“The good quality semi-automatic pistol (that Pathan used during the northeast Delhi violence) was bought from Munger in Bihar,” he added.

Singhla said Pathan had gone to the protest alone. He had five bullets but two of them fell. He fired the remaining three.

“He will be produced in court and taken into police remand,” the officer said.

During interrogation, Pathan told police he opened fire in a fit of rage as stone pelting was going on, he added.

In the viral video, Pathan, a resident of northeast Delhi’s Ghonda, could be seen pointing his pistol at the policeman on the Jaffrabad Maujpur road on February 24.

According to police, he threatened the policeman, Deepak Dahiya, before fleeing. Police are also trying to trace his family members, who are absconding, Singhla said.

On the violence in Delhi, President Trump said he did not discuss “individual attacks” and those were “up to India”.

“We did talk about religious freedom. I will say that the Prime Minister was incredible and he told me that he wants people to have religious freedom. He told me that in India they have worked very hard to have great and open religious freedom. If we look back and look at what’s going relative to other places…they have really worked hard on religious freedom,” Mr Trump said.

Asked about his position on the Citizenship Amendment Act (CAA), the US President said, I don’t want to say anything on that. It is up to India. I hope it will take the right decision for its people.”

At a news conference, Foreign Secretary Harsh Vardhan Shringla said the new citizenship law did not come up during talks between PM Modi and Mr Trump, noting the two leaders talked about religious harmony in a “positive way”.

“The issue of CAA did not come up, but with regard to what you mentioned, the term religious freedom, there was appreciation from both sides that pluralism and diversity are a common binding factor of both the countries,” he added.

Meanwhile India and the US on Tuesday finalised defence deals worth $3 billion under which 30 military helicopters will be procured from two American defence majors for Indian armed forces.
The announcement on the deals were made by US President Donald Trump after his wide-ranging talks with Prime Minister Narendra Modi.

Talking about convergence of interests between the two countries, Modi said he and Trump have decided to raise the India-US ties to the level of a comprehensive global strategic partnership.

Under a $2.6 billion deal, India will buy 24 MH-60 Romeo helicopters from Lockheed Martin for the Indian Navy. Another contract to acquire six AH-64E Apache helicopters for $800 million from aerospace giant Boeing has also been sealed.

Shops were burnt and people armed with sticks and rods were on streets in Bhajanpura, Chand Bagh and Karawal Nagar in northeast Delhi, which saw clashes between protesters for and against the controversial citizenship law spiral into unprecedented violence in the capital yesterday. The Union Home Ministry ruled out calling the army, saying adequate central forces and police are on the ground, said government sources.
Over 6,000 police and paramilitary personnel have been deployed along the stretch. This evening, police resorted to using tear gas shells in Chand Bagh to control the clashes.

The Union Home ministry has asked for no provocative statements to be made and said that Delhi’s borders with Uttar Pradesh and Haryana are being monitored to ensure no anti-social elements take advantage of the situation.

“The police personnel could not do anything because they were not getting orders from their seniors. I will raise this with Amit Shah-ji. They can’t decide whether there should be tear-gassing or lathi-charging without orders from above,” Mr Arvind Kejriwal ,Dehli CM had told reporters before his meeting.

A total of 67 companies, each with about 70 to 100 personnel, have been deployed in the Northeast district, including police and paramilitary forces. “We have enough forces on the ground. Senior police officials are constantly monitoring the situation,” said Delhi Police’s MS Randhawa this evening. “The Home Ministry is continuously supporting us. We have adequate force in place. We deny the allegations of not enough forces,” said Delhi Police chief Amulya Patnaik.

Advocate Sadhna Ramachandran, who was appointed an interlocutor along with senior advocate Sanjay Hegde, placed the report before a bench of justices S K Kaul and K M Joseph.

The bench said it would peruse the report and the matter would be heard on February 26.

It made it clear that the report of interlocutors will not be shared with the petitioners and counsels representing the Centre and Delhi Police at this stage.

At the outset, Ramachandran told the court that she is grateful for the opportunity given to her and the interlocutors had a learning experience which was positive also.

“Let us examine it. We will hear the matter day after tomorrow,” the bench said.

When the counsel for one of the petitioners said the report be shared with them also, the bench said, “We are here. Everyone is here. Let us have the benefit of the report first. The copy of the report is for the court only.”

Former Chief Information Commissioner Wajahat Habibullah had earlier told the top court that the protest was peaceful and inconvenience being caused to commuters was due to barricades “unnecessarily” put by police on roads far away from the site.

The same stand has been taken by social activist Syed Bahadur Abbas Naqvi and Bhim Army chief Chandra Shekhar Azad in their joint affidavit filed in the apex court in the matter. Habibullah, Azad and Naqvi have jointly filed an intervention application in the apex court which is seized of the matter.

The apex court had earlier said that though people have a fundamental right to protest “peacefully and lawfully”, it was troubled by the blocking of a public road at Shaheen Bagh as it might lead to a “chaotic situation”.

Naqvi and Azad, in their joint affidavit, have alleged that “the present ruling dispensation, at the behest of its political masters, had devised a strategy of extinguishing these protests by falsely attributing violence and acts of vandalism to peaceful protestors”.

Habibullah, in his affidavit, has also stated that the protestors have asked him to convey to the apex court that their dissent “was out of desperation and compulsion” as they see the CAA, National Population Register (NPR) and National Register of Citizens (NRC) as a “death knell” for their and future generations’ survival and existence.

Restrictions have been imposed on the Kalindi Kunj-Shaheen Bagh stretch and the Okhla underpass, which were closed on December 15 last year due to protests against CAA and NRC.

Meanwhile A man, who was captured on video purportedly brandishing and firing a gun during the clashes that consumed different parts of northeast Delhi on Monday, 24 February, was identified as Shahrukh and detained by the the Delhi Police on Tuesday.

The video of the incident emerged from Jaffrabad, where tensions intensified on Monday. The video seems to be shot on a mobile phone from the roof of a nearby building.

The death of Delhi Police head constable Ratan Lal on Monday during a clash between pro- and anti-CAA groups in east Delhi has shattered his family. What was their father’s mistake, his children asked the Commissioner of Police.

According to Ratan Lal’s acquaintances, he was a peace-loving person and would never get involved in any fight or argument.

The head constable was allegedly killed near Dayalpur police station by miscreants when the violence over the Citizenship (Amendment) Act or CAA was at its peak around noon.

Ratan Lal, a resident of Fathepur Tihwali village in Rajasthan’s Sikar district, joined the Delhi Police in 1998. He got married to Poonam, a resident of Jaipur, in 2004.

As the news of his death reached his house in Amrit Vihar Colony in Burari, the children started crying. Amid the chaos in Burari his relatives were informed. Mr Lal’s younger brother Manoj, who lives in Bangalore, reportedly, left for Delhi in evening.Mr Lal’s another younger brother Dinesh said, “He was the reader of the Assistant Commissioner of Police (ACP) of Gokulpuri. He had just accompanied the ACP, but the mob surrounded him and killed him.”

We never saw our brother behaving like a typical policeman, Mr Dinesh said.

Intense violence after protesters for and against the controversial citizenship law clashed and threw stones at each other, set vehicles and shops on fire. Five people, including a cop, were killed and nearly 100 were injured in Delhi. Around 20 police personnel were injured and have been hospitalised. Union Home Minister Amit Shah held a late-night meeting with the Delhi police chief, the Union Home Secretary and other senior officials.

Three firefighters have been injured after a group of people set a fire engine ablaze and threw stones at another. The violence began on Monday hours before United States President Donald Trump, was expected in the capital. Mr Trump is expected to spend the day in Delhi for the operative part of his state visit.

Delhi Chief Minister Kejriwal has called an urgent meeting of MLAs and officials from the violence-hit areas. He tweeted, “I am very worried about the prevailing situation in certain parts of Delhi. All of us together should make all efforts to restore peace in our city. I again urge everyone to shun violence.”

Delhi ministers Gopal Rai, Imran Hussain and other Aam Aadmi Party MLAs camped outside Lieutenant Governor Anil Baijal’s residence late last night to discuss with him the law and order situation. Mr Baijal said he had “instructed Delhi Police to ensure law and order is maintained”.

The Delhi government has ordered all private and government schools to be closed in the northeast Delhi district to remain closed today in the wake of the violence. Large gatherings have been banned in northeast Delhi under Section 144. They have also been imposed outside Delhi Police Headquarters after calls for protest marches by the JNU Students Union. Delhi Metro has closed the Jaffrabad, Maujpur-Babarpur, Gokulpuri, Johri Enclave and Shiv Vihar stations

Sources said the 73-year-old was taken to the hospital at around 7 in the evening. Her children, Rahul Gandhi and Priyanka Gandhi Vadra, also visited her there.

“There is nothing to worry about. She is undergoing a few tests. Based on the results, a decision will be taken whether to discharge her or keep her in the hospital until she recovers fully,” said a source. He added that the stomach ache could be due to an infection. The hospital has been Gandhi’s go-to hospital for any health issue. She has been admitted to the hospital several times over the past few years for regular health check-ups and once, in 2017, she was admitted there for shoulder surgery, said a senior doctor.

She did not attend Union Budget presentation in Parliament on Saturday. She had attended the first day of the Budget session on Friday and had led the party’s protests against Citizenship (Amendment) Act in Parliament.
