The petition, filed by general secretary SC Mishra, refutes the merger and claims the MLAs incur disqualification for voluntarily giving up their membership.

It comes a day after the party’s central leadership had on Sunday caused a new twist in the Rajasthan deadlock and issued a whip to the six MLAs to vote against the Gehlot government in any proceedings of the house, including in case of a no confidence motion.

Gehlot has been struggling to keep his government afloat after a rebellion by Sachin Pilot and MLAs loyal to him, and Mayawati’s new ploy could be just enough to tip the scales against the Congress in the state.

According to sources, Gehlot has been claiming the support of 103 MLAs in the 200-member assembly, but if the six MLAs are forced to vote against him, it could bring his government into a minority.

All the six BSP MLAs had last year merged with the Congress, which could lead to a tangle of technicalities as there are no BSP MLAs in the Rajasthan assembly.

Meanwhile Governor Kalraj Mishra today returned with queries the proposal of Chief Minister Ashok Gehlot for the assembly session from Friday. This was a revised proposal sent to the Governor but it also did not cut ice with him. The Congress has accused the governor of acting under pressure from the BJP to stall a test of strength in the assembly. The Supreme Court is all set to hear at 11am today a petition filed by Rajasthan Speaker CP Joshi against the rebel MLAs led by now-sacked deputy chief minister Sachin Pilot who engineered a revolt against the Gehlot government. The court on Thursday had refused to restrain the Rajasthan High Court from passing an order on the plea of the rebel MLAs challenging the disqualification notice against them and said it would be subject to the outcome of petition before the apex court.

Observing that the “voice of dissent” in a democracy cannot be shut down, the Supreme Court had refused to accept the plea of Rajasthan Assembly Speaker CP Joshi to either stay the matter pending before the high court or transfer it to the apex court.

The state High Court will resume hearing on Monday after rival lawyers – Harish Salve for the Pilot camp and Abhishek Singhvi for the Congress – today slogged it out in the court. The counsel for the Speaker assured the court that no order shall be passed on the notice till 5.30 pm on Tuesday.

Salve questioned the constitutional validity of the disqualification notices Speaker CP Joshi issued to 19 rebel MLAs under the anti-defection law while Singhvi termed the case premature. The dissidents are saying that dissent against the CM is part of free speech and does not constitute defection, and also that the whip is valid only for proceedings in the Assembly, not at some hotel. The adjournment gives dissidents time to strategise even as the Rajasthan police today registered two cases on a Congress complaint accusing two of its MLAs and Union Minister Gajendra Shekhawat of horse-trading and a conspiracy to dislodge the Ashok Gehlot-led state government.

Congress leader Randeep Surjewala cited audio-taped conversations today to allege “horse-trading” by party MLAs Bhanwarlal Sharma and Vishvendra Singh and Union minister Gajendra Singh Shekhawat, who dismissed the charges. The Congress also suspended Sharma and Singh from its primary membership.
As the bitter factional war in the Rajasthan Congress played itself out on streets, strategists agreed that the legal outcome would determine the future course. All eyes are now on the court. If Pilot can ward off the disqualification threat, the Gehlot government would remain on tenterhooks faced with prospects of a trust vote. Gehlot claims he has the support of 102 MLAs in a House where 101 is the majority mark. The Congress said its doors for Pilot were still open.

Union Minister Gajendra Singh Shekhawat has rejected the Congress’ allegation based on some audio clips that he was part of a conspiracy to topple the Gehlot government. “This is not my voice…. Let there be an investigation,” the senior BJP leader told the media after the Congress demanded his arrest.

Pilot, along with his camp of supporting lawmakers, skipped the Congress legislature meetings in Jaipur on Monday and on Tuesday that recommended action against him and sought to discuss his political fallout with chief minister Ashok Gehlot.

Notice issued to Sachin Pilot&18 other party members, for not attending Congress Legislative Party meetings. If they don’t respond within 2 days, then it will be considered that they are withdrawing their membership from CLP: Rajasthan Congress in-charge Avinash Pande.

Meanwhile Sachin clarified that he is not joining BJP and still in congress shows he want to avoid disqualification under anti defection law .

The truth can be harassed but not defeated,” Sachin Pilot reacted in a tweet. Later, he added: “My heartfelt thanks and gratitude to all those who have come out in my support today. Ram Ram Sa!” His supporters said the “public humiliation” of their leader was “totally unacceptable” to them and those who treated him badly should be punished.

Before Sachin Pilot’s rebellion, the Congress had 107 MLAs besides the support of 13 independents and five members from smaller parties. That number has now come down to 90 Congress MLAs, seven independent members and three from smaller parties – 100. Sachin Pilot has at least 20 MLAs on his side – 17 Congress and three independent legislators.

Mr Gehlot is banking on Sachin Pilot and other rebels being disqualified, which will bring down the half-way mark and fortify his numbers if he has to face a test of strength.

The Congress made several attempt to reach out to Mr Pilot and many leaders said how things went down was “sad”. Congress leader Randeep Singh Surjewala had said: “Doors are open for Sachin Pilot and other MLAs. They will be heard and solutions found. This is the discipline of the party,”
