आइए समझते हैं MMDR संशोधन विधेयक 2026 को, खनिज संसाधनों का बेहतर उपयोग : राज्यों के अधिकार सुरक्षित

खान और खनिज (विकास और विनियमन) संशोधन विधेयक, 2026 (MMDR संशोधन विधेयक, 2026) को बीते 13 अगस्त, 2026 को संसद ने पास किया है। इस विधेयक के सेक्शन 9(घ) के तहत खनिज अधिकारों या खनिज-युक्त भूमि पर कर, उपकर या अन्य शुल्क (चाहे वे खनिज की मात्रा, मूल्य या रॉयल्टी के आधार पर हों) लगाने का अधिकार राज्यों के पास ही रहेगा, परंतु केन्द्रीय सरकार उनको विनियमित कर सकती है।

इस विधेयक को लेकर आम लोगों के मन में कई तरह के सवाल और भ्रांतियां हैं। ऐसे में जरूरी है कि विधेयक से जुड़ी सही और स्पष्ट जानकारी सरल भाषा में सामने रखी जाए।

सबसे बड़ा सवाल यही है कि क्या विधेयक से राज्यों के अधिकार प्रभावित होंगे? क्या राज्यों के राजस्व में कमी आएगी? क्या जमीन पर राज्यों का नियंत्रण खत्म हो जाएगा? आइए, इन सभी सवालों को आसान भाषा में समझते हैं।

स्पष्ट रूप से कहें तो विधेयक का उद्देश्य राज्यों के अधिकार या उनके राजस्व को कम करना नहीं है, बल्कि खनिज क्षेत्र में कराधान और नियमन को अधिक स्पष्ट, पारदर्शी और एकरूप बनाना है।

सबसे अहम बात यह है कि राज्यों की जमीन पर उनका अधिकार बना रहेगा, खनन से प्राप्त राजस्व राज्यों को मिलता रहेगा और गौण खनिजों के नियमन एवं नियंत्रण का अधिकार भी राज्यों के पास ही रहेगा।

राज्यों के राजस्व पर कोई कटौती नहीं

इस विधेयक को लेकर दूसरा बड़ा सवाल राज्यों के राजस्व से जुड़ा है। क्या केंद्र के इस सुधार से राज्यों की खनन से होने वाली आय कम हो जाएगी?

इसका भी जवाब है- नहीं।

विधेयक से पहले खनन क्षेत्र से राज्यों को जो राजस्व हिस्सा मिलता रहा है, उसमें कोई कमी नहीं की जा रही है। राज्यों का हिस्सा लगभग 90 प्रतिशत के स्तर पर बना रहेगा। अर्थात सुधार का मतलब राज्यों की आय कम करना नहीं है। बल्कि उद्देश्य यह है कि खनिज क्षेत्र में कराधान की व्यवस्था अधिक स्पष्ट हो, विकास को गति मिले और साथ ही राज्यों के राजस्व हित भी सुरक्षित रहें।

राज्यों की जमीन नहीं ली जा रही

सबसे पहले इस सवाल को समझना जरूरी है, जो इस पूरे विषय की चर्चा के केंद्र में है, क्या केन्द्रीय सरकार राज्यों की खनिज-युक्त जमीन अपने नियंत्रण में लेने जा रही है?

इसका जवाब है– नहीं।

MMDR संशोधन विधेयक, 2026 का संबंध जमीन के मालिकाना हक को बदलने से नहीं है। यानी जिस जमीन पर राज्य का अधिकार है, वह अधिकार इस विधेयक के कारण खत्म नहीं होता है।

विधेयक का उद्देश्य खनिज-युक्त भूमि पर लगाए जाने वाले कराधान से जुड़े विषयों को स्पष्ट और व्यवस्थित करना है। इसे जमीन के अधिकार से जोड़कर देखना सही नहीं होगा। सरल शब्दों में कहें तो जमीन का अधिकार अपनी जगह है और खनिजों से जुड़े कर एवं नियमन का विषय अपनी जगह। यही अंतर इस पूरे मुद्दे को समझने के लिए सबसे महत्वपूर्ण है।

गौण खनिजों पर राज्यों का नियंत्रण बरकरार

देश में कई ऐसे खनिज हैं, जिन्हें आमतौर पर रोजमर्रा के निर्माण कार्यों में इस्तेमाल किया जाता है। जैसे- रेत, बजरी, बोल्डर, मोरम आदि। ये माइनर मिनरल्स यानी गौण खनिज हैं और इन पर राज्यों का पहले की तरह अधिकार बना रहेगा।

MMDR संशोधन विधेयक, 2026 में इन गौण खनिजों के संबंध में कोई बदलाव नहीं किया गया है। करीब 50 Minor Minerals राज्यों के नियंत्रण में ही रहेंगे। इसका सीधा मतलब है- इन खनिजों को राज्य ही नियमन करेंगे, राज्य ही निर्णय लेंगे। यानी रेत, बजरी, बोल्डर, मोरम जैसे गौण खनिजों से जुड़े नियमन और प्रशासन में राज्यों की भूमिका पहले की तरह बनी रहेगी। यह व्यवस्था इसलिए भी महत्वपूर्ण है क्योंकि इन खनिजों का सीधा संबंध स्थानीय स्तर पर निर्माण कार्यों, सड़कों, मकानों, बुनियादी ढांचे एवं संबंधित राज्यों के विकास से संबंधित है।

राज्यों को मिलने वाले राजस्व के प्रमुख स्रोत सुरक्षित

खनन क्षेत्र से राज्यों को अलग-अलग माध्यमों से राजस्व प्राप्त होता है। इनमें रॉयल्टी, ऑक्शन प्रीमियम, जिला खनिज फाउंडेशन यानी DMF से मिलने वाले लाभ और GST में राज्यों का हिस्सा प्रमुख हैं।

MMDR संशोधन विधेयक, 2026 के तहत इन राजस्व स्रोतों में राज्यों के हिस्से को सुरक्षित रखा गया है। यानी

*रॉयल्टी से मिलने वाला राजस्व जारी रहेगा।*
*ऑक्शन प्रीमियम से राज्यों को मिलने वाला हिस्सा मिलता रहेगा।*
*DMF के माध्यम से मिलने वाले लाभ जारी रहेंगे।*
*GST में राज्यों का हिस्सा भी सुरक्षित रहेगा।*

इसका मतलब साफ है कि खनिज क्षेत्र में सुधार और विकास के साथ राज्यों के आर्थिक हितों की भी रक्षा की जाएगी।

जमीन के अधिकार और कराधान में फर्क समझना जरूरी

दरअसल, जमीन का मालिकाना हक संबंधित राज्य के पास ही रहेगा। जमीन पर खनिज मौजूद होने की स्थिति में खनिज से जुड़े कर या शुल्क का सवाल अलग विषय है। MMDR संशोधन विधेयक इसी तरह के कराधान के विषयों को संबोधित करता है, जमीन के मालिकाना हक को नहीं।

इसलिए यह कहना कि विधेयक के कारण राज्यों से जमीन छीनी जा रही है, सही नहीं होगा। वास्तविकता यह है कि जमीन के अधिकार और खनिज-युक्त भूमि पर कराधान दो अलग-अलग विषय हैं।

आखिर सुधार की जरूरत क्यों?

अब सवाल उठता है कि जब राज्यों के अधिकार और राजस्व में कोई कटौती नहीं हो रही है, तो फिर इस तरह के संशोधन की जरूरत क्यों पड़ी?

दरअसल, खनिज क्षेत्र देश की अर्थव्यवस्था के लिए बेहद महत्वपूर्ण है। उद्योग, निर्माण, ऊर्जा, सड़क, रेलवे और कई दूसरे क्षेत्रों की जरूरतें खनिज संसाधनों से जुड़ी हैं।

समय के साथ इस क्षेत्र में नई परिस्थितियां और नई चुनौतियां सामने आई हैं। ऐसे में नियमों में स्पष्टता और एकरूपता जरूरी हो जाती है। इसी दिशा में यह संशोधन कराधान से जुड़े प्रावधानों को अधिक स्पष्ट करने का प्रयास करता है। यानी इसका मकसद राज्यों के अधिकारों को कमजोर करना नहीं, बल्कि ऐसी व्यवस्था बनाना है जिसमें नियम स्पष्ट हों और खनिज क्षेत्र में काम करने वाले सभी पक्षों को अपनी जिम्मेदारियों और दायित्वों की स्पष्ट जानकारी हो।

14 तरह के मौजूदा लेवी और जरूरत स्पष्ट नियमों की

खनिज क्षेत्र में अलग-अलग स्तरों पर कई तरह के कर और शुल्क पहले से लागू रहे हैं। राज्यों की ओर से 14 मौजूदा लेवी लगाए जाने की स्थिति में कराधान की व्यवस्था कई बार जटिल हो सकती है।

ऐसे में स्पष्ट और समान कर व्यवस्था की जरूरत महसूस होती है, ताकि सरकार, उद्योग और अन्य हितधारकों के बीच नियमों को लेकर भ्रम की स्थिति पैदा ना हो।

सुधार और राज्यों के हित साथ-साथ

किसी भी नीति सुधार की असली सफलता तभी मानी जाती है, जब उससे विकास के साथ-साथ सभी संबंधित पक्षों के हित भी सुरक्षित रहें। MMDR संशोधन विधेयक, 2026 के संदर्भ में यही बात महत्वपूर्ण है।

एक तरफ देश को खनिज क्षेत्र में विकास, निवेश और बेहतर व्यवस्था की जरूरत है, वहीं दूसरी तरफ राज्यों के अधिकार और राजस्व भी उतने ही महत्वपूर्ण हैं। इस विधेयक के तहत दोनों के बीच संतुलन बनाने की कोशिश दिखाई देती है।

राज्यों के अधिकार बने रहें, राज्यों का राजस्व बना रहे और खनिज क्षेत्र में सुधार भी हो यही इस व्यवस्था की सबसे महत्वपूर्ण बात है।

राज्यों के लिए संदेश साफ है

राज्यों की जमीन नहीं ली जा रही, छोटे खनिज राज्यों के नियंत्रण में ही रहेंगे और खनन क्षेत्र से मिलने वाले राज्यों के राजस्व में कोई कमी नहीं की जा रही है। लगभग 90 प्रतिशत खनन क्षेत्र का राजस्व हिस्सा राज्यों के पास बना रहेगा। रॉयल्टी, ऑक्शन प्रीमियम, DMF और GST जैसे राजस्व स्रोतों से मिलने वाला राज्यों का हिस्सा भी सुरक्षित रहेगा। यानी यह बदलाव राज्यों को कमजोर करने के बजाय खनिज क्षेत्र में व्यवस्था को अधिक स्पष्ट बनाने की दिशा में है।

विकास का फायदा राज्य और देश दोनों को

भारत आज तेजी से बुनियादी ढांचे का विस्तार कर रहा है। नए एक्सप्रेस वे, रेलवे लाइन, उद्योग, आवास और ऊर्जा परियोजनाएं देश के विकास की तस्वीर बदल रही हैं।

इन सभी के लिए खनिज संसाधनों की जरूरत होती है। इसलिए खनिज क्षेत्र में यदि नियम सरल और स्पष्ट होते हैं, निवेश का माहौल बेहतर होता है और परियोजनाएं तेजी से आगे बढ़ती हैं, तो इसका फायदा केवल केंद्र को नहीं, बल्कि राज्यों को भी मिलता है।

अधिक आर्थिक गतिविधियों का मतलब है- अधिक रोजगार, अधिक स्थानीय कारोबार और राज्यों के लिए अधिक आर्थिक अवसर। इसलिए खनिज क्षेत्र में सुधार को देश बनाम राज्य के नजरिए से देखने के बजाय देश और राज्य दोनों के विकास के नजरिए से देखना अधिक उपयोगी होगा।

“आइए, केंद्र एवं राज्य सरकारों के संबंधों की गरिमा, आपसी सहयोग और समन्वय को बनाए रखते हुए ‘विकसित भारत-2047’ के सपने को साकार करने की दिशा में हम सभी मिलकर मजबूती से आगे बढ़ें।”

India’s First 21 CuM Electric Shovel Commissioned at SECL’s Gevra Mega Project

India’s first 21 CuM capacity electro-hydraulic face shovel has been commissioned at South Eastern Coalfields Limited’s (SECL) Gevra Mega Project in Korba district, Chhattisgarh, marking a significant step towards modernising coal mining operations. SECL Chairman-cum-Managing Director Shri Harish Duhan inaugurated the advanced machine, which is expected to enhance coal production capacity at Gevra, Asia’s largest coal mine, while supporting safer, more efficient and technology-driven mining. Equipped with advanced operator-centric and safety features such as a 360-degree camera, Operator Fatigue Monitoring System, air-suspension seat, adjustable joysticks, hydraulic access stairs, gas-based fire suppression system and a FOPS-compliant safety cabin, the new shovel is set to strengthen operational efficiency and safety standards at the mega project.

Air Cargo Operations Witness Nearly 40% Growth, Says Civil Aviation Minister

NEW DELHI. Civil Aviation Minister K. Ram Mohan Naidu has said that India’s air cargo sector has recorded consistent growth in recent years, with cargo volumes rising by nearly 40 per cent, as the government works to develop global-standard air cargo hubs and facilities across the country. Speaking to reporters in New Delhi, the Minister said Prime Minister Narendra Modi has stressed the need to expand India’s logistics network, while noting that FedEx and GMR Airports have partnered to establish a dedicated air cargo facility at Delhi airport. On the Air India Phuket-Delhi flight incident, Naidu said the Aircraft Accident Investigation Bureau is conducting an investigation and that its preliminary report is expected soon. The incident took place on the 4th of the month when the Delhi-bound aircraft reportedly experienced a sudden loss of altitude of around 300 feet during cruise.

Six Management Trainees Inducted into SAIL, Rourkela Steel Plant

Six Management Trainees (Technical) have been inducted in SAIL, Rourkela Steel Plant (RSP). Their local induction commenced at Samadhan, the conference hall of the Executive Director (HR), and was organised by the Human Resource–Learning and Development (HR-L&D) department.

Mr. Tarun Misra, Executive Director (HR), graced the occasion as the Chief Guest. Mr. B. R. Palai, Executive Director (Works), and Mr. M. P. Singh, Executive Director (Mines), were also present on the occasion.

Addressing the newly inducted trainees, Mr. Tarun Mishra welcomed them to RSP and highlighted the plant’s township and work environment. He stated that Rourkela Steel Plant has one of the best townships and is among the best places to work.

Mr. B. R. Palai, Executive Director (Works), emphasised the importance of adopting a multiskilling work culture and urged them to focus on their career roadmap and work systematically towards achieving their professional goals.

Mr. M. P. Singh, Executive Director (Mines), encouraged the trainees to make the most of the learning and professional opportunities available within the organisation.

The programme provided the trainees with an overview of the organisation, its work culture and the opportunities available for professional growth at SAIL, RSP. It is worth mentioning that the central induction of all the Management Trainees (Technical) joining SAIL was carried out at Bhilai Steel Plant. Thereafter, the trainees have been posted to different units for local induction.
